i to construct Diablo Nuclear Power Plant Unit 2 This amended motion is submitted in compliance with 10 CFR 2.771 and 2.764. j

In the light of the decision of the United States Court of Appeals for tne Dis brict of Columbia Circuit (Calvert Cliffs' Coordinating Committee, Inc. , National Wild. life Federation and Sierra l

Club v. United States Atomic Energy Commission), the construction i

permit for Unit 2 granted by the Board has been invalidly granted and is a nullity. The percit is illegal because the applicant l and Commission have not pursued. the necessary procedures required i under the provisions of the National Environmental Policy Ac.t of l 1970 (NEPA).

I Scenic Shoreline, therefcre, requests new hearings to consider j the environmental impact of Diablo Unit 2 in response to the courts decision that such environmental review be undertaken at the earliest j 1

possible date. It is not the intent of this amended motion to have a rehearing on all the issues already resolved by the Dcari although i our organization intends to seek remedy in court on those issues in contention if the appli:ation for construction is not finally l turned down, Scenic Shcreline does, however, reaffirm the importance of considering the eartlcuake design issue raised in our earlier l l
