The U.S. Nuclear Regulatory Commission (NRC; the staff) has prepared the enclosed draft supplement to the final plant-specific Supplement 38 to NUREG-1437, "Generic Environmental Impact Statement for License Renewal of Nuclear Plants" (SEIS), regarding the license renewal of Indian Point Nuclear Generating Unit Nos. 2 and 3 (IP2 and IP3) in accordance with the National Environmental Policy Act of 1969, as amended (NEPA). With this letter, I am forwarding you a copy of the draft supplement for your review.  
The U.S. Nuclear Regulatory Commission (NRC; the staff) has prepared the enclosed draft supplement to the final plant-specific Supplement 38 to NUREG-1437, Generic Environmental Impact Statement for License Renewal of Nuclear Plants (SEIS), regarding the license renewal of Indian Point Nuclear Generating Unit Nos. 2 and 3 (IP2 and IP3) in accordance with the National Environmental Policy Act of 1969, as amended (NEPA). With this letter, I am forwarding you a copy of the draft supplement for your review.
 
The NRC staff published its final supplemental environmental impact statement (FSEIS) for IP2 and IP3 in December 2010. Subsequent to publishing the FSEIS, the NRC staff identified information that necessitated changes to its assessments in the FSEIS related to entrainment and impingement of aquatic organisms and thermal effects. The staff prepared a supplement to the FSEIS, which was issued as final in June 2013.
The NRC staff published its final supplemental environmental impact st atement (FSEIS) for IP2 and IP3 in December 2010. Subsequent to publishing the FSEIS, the NRC staff identified information that necessitated changes to its assessments in the FSEIS related to entrainment and impingement of aquatic organisms and thermal effects. The staff prepared a supplement to the FSEIS, which was issued as final in June 2013.  
In September 2014, the NRC issued a Federal Register notice (79 FR 52059) stating its intent to prepare a second supplement to the FSEIS to evaluate new information identified subsequent to the publication of the June 2013 supplement, including new aquatic impact data, refined cost estimates associated with the licensees severe accident mitigation alternatives analysis, and other matters. The draft does not request re-initiation of Endangered Species Act (ESA) section 7 consultation with the National Oceanic and Atmospheric Administration (NOAA) and does not present new information regarding ESA-listed species under NOAAs jurisdiction that NOAA staff has not already seen. This draft supplement, published as Volume 5 of the FSEIS, documents the NRC staffs evaluation of the new information.
 
In September 2014, the NRC issued a Federal Register notice (79 FR 52059) stating its intent to prepare a second supplement to the FSEIS to evaluate new information identified subsequent to the publication of the June 2013 supplement, including new aquatic impact data, refined cost estimates associated with the licensee's severe accident mitigation alternatives analysis, and other matters. The draft does not request re-initiation of Endangered Species Act (ESA) section 7 consultation with the National Oceanic and Atmospheric Administration (NOAA) and does not present new information regarding ESA-listed species under NOAA's jurisdiction that NOAA staff has not already seen.
