FINAL SIGNIFICANCE DETERMINATION FOR A SECURITY-RELATED GREATER THAN GREEN FINDING; NRC SPECIAL INSPECTION REPORT 05000313/2014406 AND 05000368/2014406; ARKANSAS NUCLEAR ONE, UNITS 1 AND 2
Dear Mr. Browning:
This letter provides the final results of our significance determination for the preliminary Greater-than-Green finding identified in NRC Inspection Report 05000313/2013406 and 05000368/2013406, dated March 25, 2014. The subject finding was discussed in detail in Section 3 of the March 25, 2014, inspection report.
In a telephone conversation with Mr. Mark Haire, Chief, Plant Support Branch 1, of the Nuclear Regulatory Commission (NRC), Region IV office, on April 2, 2014, Ms. Stephanie Pyle, Manager, Regulatory Assurance, of your staff indicated that Arkansas Nuclear One, Entergy Operations, Inc., did not contest the characterization of this finding and that you declined your opportunity to discuss this issue in a Regulatory Conference, but intended to provide a written response.
In a letter dated April 22, 2014, you provided a response to the NRC staff preliminary determination regarding t he finding. Your response wa s reviewed and the NRC concluded that your corrective actions are appropriate for the violation associated with the finding.
UNITED STATES NUCLEAR REGULATORY COMMISSION REGION IV 1600 E LAMAR BLVD ARLINGTON, TX 76011-4511 After considering the information developed during the inspection and the additional information you provided in your letter dated April 22, 2014, the NRC has concluded that the inspection finding is appropriately characterized as Greater-than-Green as described in the attached Notice of Violation (Notice).
If you decide to appeal the staff's determination of significance for the subject finding, you have 30 calendar days from the date of this letter to initiate that appeal. Such an appeal will be considered to have merit only if it meets the criteria specified in NRC Inspection Manual Chapter 0609, Attachment 2, "Process for Appealing NRC Characterization of Inspection Findings (SDP Appeal Process)."
The NRC also determined that the finding involves a violation of NRC requirements as cited in the attached Notice. In accordance with the NRC Enforcement Policy, the Notice is considered escalated enforcement action because it is associated with a Greater-than-Green finding.
Because plant performance for this issue has been determined to be beyond the licensee
response band, we will use the NRC's Action Matrix to determine the most appropriate NRC response for this event. We will notify you by separate correspondence of that determination.
In accordance with 10 CFR 2.390 of the NRC's "Rules of Practice and Procedure," a copy of
this letter will be made available electronically for public inspection in the NRC Public Document Room or in the NRC's Agencywide Documents Access and Management System (ADAMS), accessible from the NRC website at http://www.nrc.gov/reading-rm/adams.html. However, the material enclosed herewith contains Security-Related Information in accordance with 10 CFR 2.390(d)(1) and its disclosure to unauthorized individuals could present a security vulnerability. Therefore, the material in the enclosure will not be made available electronically for public inspection in the NRC Public Document Room or in the NRC's Agencywide Documents Access and Management System (ADAMS), accessible from the NRC website at http://www.nrc.gov/reading-rm/adams.html. If Security-Related Information is necessary to provide an acceptable response, please mark your entire response Security-Related Information in accordance with 10 CFR 2.390(d)(1) and follow the instructions for withholding in 10 CFR 2.390(b)(1).
