By letter dated August 29, 2017 (Agencywide Documents Access and Management System (ADAMS) Accession No. ML 17241 A278), Exelon Generation Company, LLC (EGC) submitted the following 2 affidavits:

Both dated May 16, 2017, executed by Brian R. Moore, General Manager, Core & Fuel Engineering Global Nuclear Fuel [GNF] -Americas, LLC, 3901 Castle Hayne Road, Wilmington, NC 28401, requesting that the information contained in the following documents be withheld from public disclosure pursuant to Title 1 O of the Code of Federal Regulations (1 O CFR), Part 2, Section 2.390: (1) Exelon letter dated August 29, 2017, Attachment 3 (ADAMS Accession No. ML17241A284), GNF proprietary report 004N2838 R1-P, "GNF Additional Information Regarding the Requested Changes to the Technical Specification SLMCPR [safety limit for minimum critical power ratio] LaSalle Unit 1 Cycle 17, dated May 2017. (2) Exelon letter dated August 29, 2017, Attachment 4 (ADAMS Accession No. ML17241A285), GNF proprietary report 004N2839 R1-P, "GNF Additional Information Regarding the Requested Changes to the Technical Specification SLMCPR LaSalle Unit 2 Cycle 17," dated May 2017. The nonproprietary versions of these documents are available in Attachments 5 and 6 of your submission dated August 29, 2017 (ADAMS Accession No. ML 17241 A278). The affidavits stated that the submitted information should be considered exempt from mandatory public disclosure for the following reasons: (4) a. Information that discloses a process, method, or apparatus, including supporting data and analyses, where prevention of its use by GNF-A's competitors without B. Hanson license from GNF-A constitutes a competitive economic advantage over other companies; (4) b. Information that, if used by a competitor, would reduce its expenditure of resources or improve its competitive position in the design, manufacture, shipment, installation, assurance of quality, or licensing of a similar product; (8) The information identified in [Attachments 3 and 4 of the Letter dated August 29, 2017] is classified as proprietary because it contains details of GNF-A's fuel design and licensing methodology.

The development of this methodology, along with the testing, development and approval was achieved at a significant cost to GNF-A. The development of the fuel design and licensing methodology along with the interpretation and application of the analytical results is derived from an extensive experience database that constitutes a major GNF-A asset. We have reviewed your application and the material in accordance with the requirements of 10 CFR 2.390 and, on the basis of the statements in the affidavit, have determined that the submitted information sought to be withheld contains proprietary commercial information and should be withheld from public disclosure.

Therefore, the applicable portions of Attachments 3 and 4 of the submission marked as proprietary, will be withheld from public disclosure pursuant to 10 CFR 2.390(b)(5) and Section 103(b) of the Atomic Energy Act of 1954, as amended. Withholding from public inspection shall not affect the right, if any, of persons properly and directly concerned to inspect the documents.

If the need arises, we may send copies of this information to our consultants working in this area. We will, of course, ensure that the consultants have signed the appropriate agreements for handling proprietary information.

If the basis for withholding this information from public inspection should change in the future such that the information could then be made available for public inspection, you should promptly notify the Nuclear Regulatory Commission (NRC). You also should understand that the NRC may have cause to review this determination in the future, for example, if the scope of a Freedom of Information Act request includes your information.

In all review situations, if the NRC makes a determination adverse to the above, you will be notified in advance of any public disclosure.
