LASALLE COUNTY STATION, UNITS 1 AND 2-REQUEST FOR WITHHOLDING INFORMATION FROM PUBLIC DISCLOSURE (TAC NOS. ME3288 AND ME3289)
Dear Mr. Pardee:
By letter to the Nuclear Regulatory Commission (NRC) dated January 27, 2010 (Agencywide Documents Access and Management System (ADAMS) Package No. ML100321303), Exelon Generation Company, LLC (EGC) submitted two affidavits dated January 11,2010, and January 27, 2010, executed by Edward D. Schrull, Vice President, Services Licensing, Regulatory Affairs, GE-Hitachi Nuclear Energy Americas LLC. (GEH) and Ernest M. Hauser, Director of Sales, Caldon Ultrasonics Technology Center, respectively, requesting that information designated proprietary in the following documents be withheld from public disclosure pursuant to paragraph (a)(4) of Title 10 of the Code of Federal Regulations (10 CFR), Part 2, Section 2.390:
NEDC-33485P, Revision 0, January 2010, "Safety Analysis Report for LaSalle County Station Units 1 and 2, Thermal Power Optimization;"
Caldon Ultrasonics Engineering Report ER-629, Revision 1, "Bounding Uncertainty Analysis for Thermal Power Determination at LaSalle Unit 1 Using LEFM" + System;"
- Caldon Ultrasonics Engineering Report ER-644, Revision 0, "LEFM" + Meter Factor Calculation and Accuracy Assessment for LaSalle Unit 1 Nuclear Power Station;"
- Caldon Ultrasonics Engineering Report ER-746, Revision 1a, "Bounding Uncertainty Analysis for Thermal Power Determination at LaSalle Unit 2 Using LEFM" + System;"
Caldon Ultrasonics Engineering Report ER-791, Revision 0, "Meter Factor Calculation and Accuracy Assessment for LaSalle Unit 2."
The proprietary version of the documents and the affidavits are in Attachments 6, 7, 9 and 10 to the letter dated January 27,2010, from EGC to the U.S. Nuclear Regulatory Commission (NRC),
for the LaSalle County Station, Units 1 and 2.
A non-proprietary copy of the documents, provided as Attachment 8 to the letter dated January 27,2010, has been added to the ADAMS Public Electronic Reading Room (ADAMS Accession No. ML100321326).
The affidavits stated that the submitted information should be considered exempt from mandatory public disclosure for the following reasons:
(a) Information that discloses a process, method, or apparatus, including supporting data and analyses, where prevention of its use by the owner's competitors without license from the owner constitutes a competitive economic advantage over other companies;

- 2 (b) Information which, if used by a competitor, would reduce his expenditure of resources or improve his competitive position in the design, manufacture, shipment, installation, assurance of quality, or licensing of a similar product; (c) Information which reveals aspects of past, present, or future customer-funded development plans and programs, resulting in potential products to the owner; (d) Information which discloses patentable subject matter for which it may be desirable to obtain patent protection.
We have reviewed your submittal in accordance with the requirements of 10 CFR 2.390 and, on the basis of the statements in the affidavit, have determined that the information sought to be withheld contains proprietary commercial information and should be withheld from public disclosure.
Therefore, the version of the submitted information marked as proprietary will be withheld from public disclosure pursuant to 10 CFR 2.390(b)(5) and Section 103(b) of the Atomic Energy Act of 1954, as amended.
Withholding from public inspection shall not affect the right, if any, of persons properly and directly concerned to inspect the documents. If the need arises, we may send copies of this information to our consultants working in this area. We will, of course ensure that the consultants have signed the appropriate agreements for handling proprietary information.
If the basis for withholding this information from public inspection should change in the future such that the information could then be made available for public inspection, you should promptly notify the NRC. You should also understand that the NRC may have cause to review this determination in the future, for example, if the scope of a Freedom of Information Act request includes your information. In all review situations, if the NRC makes a determination adverse to the above, you will be notified in advance of any public disclosure.
