Supplemental Environmental Impact Statement Scoping Process Summary Report Comanche Peak Nuclear Power Plant Unit Nos. 1 and 2 Somervell County, TX October 2023 U.S. Nuclear Regulatory Commission Rockville, MD Introduction On October 3, 2022, the U.S. Nuclear Regulatory Commission (NRC) received an application from Vistra Operations Company LLC (Vistra, the applicant) requesting renewal of the operating licenses for Comanche Peak Nuclear Power Plant, Units 1 and 2 (CPNPP) in Somervell County, TX. In its application, Vistra requests license renewal for a period of 20 years beyond the expiration of the current renewed operating licenses. If granted, the renewed licenses would expire on February 8, 2030, for CPNPP Unit No. 1 and on February 2, 2033, for CPNPP Unit No. 2.1 The purpose of this report2 is to (1) summarize the determination of the scope of the NRC staffs environmental review of this application, incorporating stakeholder input, and (2) describe the issues identified by the environmental impact statement (EIS) scoping process, consistent with Title 10 of the Code of Federal Regulations (10 CFR) 51.29, Scoping-environmental impact statement and supplement to environmental impact statement.

This report is structured in three sections:

The CPNPP License Renewal Public Scoping Period A.1

Background

On October 3, 2022, as part of its CPNPP license renewal application (LRA), Vistra submitted an environmental report (ER) to the NRC. Vistra prepared its ER in accordance with 10 CFR Part 51, Environmental Protection Regulations for Domestic Licensing and Related Regulatory Functions, which contains the NRCs requirements for implementing the National Environmental Policy Act of 1969, as amended (NEPA).3 The CPNPP LRA and all other relevant public documents are available in the NRC's Agencywide Documents Access and Management System (ADAMS). A.2 Scoping Process and Objectives Consistent with 10 CFR 51, the first step in developing a supplemental environmental impact statement (SEIS) is to conduct a public scoping process to help staff determine the scope of the SEIS. On December 13, 2022, the NRC published a Federal Register (FR) notice announcing the staffs intent to prepare a SEIS for the CPNPP LRA and conduct a public environmental scoping process. The December 13, 2022 FRN (87 FR 76219) described the scoping process and invited the public and stakeholders to participate by submitting written comments by January 30, 2023. On February 22, 2023, the NRC staff published a second FR notice (88 FR 10940) to extend the comment period to March 13, 2023.

The scoping process provided an opportunity for members of the public to highlight concerns and issues to be addressed in the SEIS. This scoping summary report (1) summarizes the comments that the NRC received and (2) provides the determinations and conclusions that the NRC staff reached, during the scoping process. The objectives for the scoping process are as follows (10 CFR 51.29):

Define the proposed action, which is to be the subject of the supplement to the Generic Environmental Impact Statement (GEIS) SEIS.

Gather data on the scope of the SEIS and identify the significant issues to be analyzed in depth.

Identify and eliminate from detailed study the issues that are peripheral or are not significant or were covered by a prior environmental review.

Identify any environmental assessments and other EISs that are being or will be prepared that are related to, but are not part of, the scope of the SEIS.

Identify other environmental review and consultation requirements related to the proposed action.

Indicate the relationship between the timing of the preparation of the environmental analyses and the Commission's tentative planning and decision-making schedule.

Identify any cooperating agencies and, as appropriate, allocate assignments for preparation and schedules of the SEIS completion, to the NRC and any cooperating agencies.

Describe how the SEIS will be prepared, including any contractor assistance.

The NRC staffs determinations and conclusions regarding the above objectives are provided below.

A.3 Define the Proposed Action The NRCs proposed action is to determine whether to renew the CPNPP operating licenses for an additional 20 years.

A.4 Scope of Review and Issues that Are Peripheral or not Significant The scope of the SEIS includes an evaluation of the environmental impacts of and reasonable alternatives to CPNPPs license renewal, including the no action alternative. The Public Comments section of this report includes specific issues identified by the scoping comments.

Consistent with 10 CFR 51.29, the NRC will not consider further in the draft SEIS those issues that do not pertain to the staffs environmental evaluation or are beyond the scope of the license renewal review. The issues include (1) changes to plant cooling systems, (2) disposition of spent nuclear fuel, (3) emergency preparedness, (4) safeguards and security, (5) need for power or the economic costs and economic benefits of the proposed action, and (6) seismicity and flooding (NRC 2013 GEIS). General comments that do not raise significant issues or comments that challenge the NRC regulations and are the subject of petition for rule making will not be considered further in the draft SEIS.

A.5 Identification of Related Environmental Assessments and Other EISs The NRC staff did not identify any upcoming or in-progress environmental assessments that relate to, but are not within the scope of, the CPNPP SEIS. As it prepares the SEIS, the staff will consider previously completed EISs, such as:

the License Renewal GEIS (ML13107A023) the Final Environmental Statement for the construction and operation of CPNPP, Units 1 and 2 (ML20079M793 and ML19332D079) the EIS for the combined license for proposed CPNPP Unit 3 and 4 (ML11131A001).

A.6 Other Environmental Review and Consultation Requirements In parallel with its National Environmental Policy Act (NEPA) review, the NRC staff is consulting with the U.S. Fish and Wildlife Service under Section 7 of the Endangered Species Act of 1973 to evaluate the potential impacts of the operation of CPNPP for an additional 20 years on endangered and threatened species and their critical habitats. Consistent with 36 CFR 800.8(c),

Use of the NEPA Process for Section 106 Purposes, the NRC staff is consulting with affected Native American Tribes and the State Historic Preservation Officer of Texas to fulfill its Section 106 obligations under the National Historic Preservation Act of 1966.

A.7 Timing of Agency Action Upon completion of the scoping process and site audits, its review of Vistras environmental report (ER) and related documents, and its own independent evaluations, the NRC staff will compile its findings in a draft SEIS. The NRC staff will make the draft SEIS available for public comment. Based on the information gathered during this public comment period of minimum 45 days, the NRC staff will amend the draft SEIS findings, as necessary, and will then publish the final SEIS. The NRC staff will also prepare and provide a record of decision in accordance with 10 CFR 51.102, Requirement to provide a record of decision; preparation and 10 CFR 51.103, Record of decision - general. At the same time, but separately and peripherally to the environmental review, the NRC staff will conduct a safety review and document its results in a safety evaluation report (SER). The NRC Nuclear Reactor Regulation Office Director, as delegated by the Commission, will consider the findings in both the SEIS and the SER in its decision to issue or deny the CPNPP renewed licenses, currently scheduled to occur by September 2024 (see project information at the CPNPP project Website listed in the Background section above).

A.8 Identification of Cooperating Agencies No other Federal agency is participating in the environmental review as a cooperating agency.

A.9 How the SEIS will be Prepared, Including Contractor Assistance The SEIS will be prepared by the NRC staff with support from Pacific Northwest National Laboratory (a U.S. Department of Energy National Laboratory).

A.10 Future Opportunities for Public Participation The NRC staff plans to issue the draft SEIS for public comment in October 2023. The draft SEIS public comment period will provide an opportunity for members of the public; the applicant; interested Federal, State, and local government agencies; Tribal governments; and local organizations to provide further input into the NRCs environmental review. The NRC staff will consider the comments received on the draft SEIS in the preparation of the final SEIS. The SEIS, along with the NRC staffs SER, will document the information considered and evaluations performed by the NRC staff in reviewing the CPNPP LRA. The Advisory Committee Reactor Safeguards will provide an independent review of the LRA and the SER and will convene public meeting(s), as appropriate. The SEIS and SER information and schedule can be found at the CPNPP project Website (see Background section above).

A.11 Scoping Process Conclusion The comments provided during the environmental scoping process identified appropriate issues that the NRC staff will consider in its draft SEIS for CPNPPs license renewal. Consistent with 10 CFR 51.29, the NRC will not consider further in the draft SEIS those issues that do not pertain to the staffs environmental evaluation or are beyond the scope of the license renewal review (see above Scope of Review and Issues that are Peripheral or not Significant).

Public Comments During the scoping comment period (87 FR 76219 and 88 FR 10940), the NRC staff received public comments for consideration in the development of the SEIS. This section of the report summarizes the scoping comments. Each comment submittal received (e.g., via www.regulations.gov, emails, or verbal) was uniquely identified with a commenter identification number. Section C of this report contains tables that identify the commenters, their affiliation if provided, and the ADAMS accession number for the comment submittals.

B.1 Comments on the Resource Areas B.1.1 Postulated Accidents Comment Summary (Accidents - SAMAs): Commenters expressed concerns regarding accidents at Comanche Peak, Units 1 and 2. One commenter requested that the plausible worst-case scenarios be disclosed to the public. Another commenter expressed concern about accidents releasing airborne toxins.

B.1.2 Alternative - No - Action Comment Summary: A commenter requested that the NRC consider not renew the operating license or consider a shorter period for operating license renewal for Comanche Peak Units 1 and 2.

Comment Summary (No - Action - Decommissioning): Commenters expressed concerns about decommissioning including the impacts of decommissioning, particularly the economic impacts, costs for decommissioning, and nuclear waste management of Comanche Peak Units 1 and 2.

B.1.3 Alternatives - Replacement Power Comment Summary: The following comments are related to alternative energy sources.

Commenters requested that the NRC address in the SEIS both the benefits and impacts of alternative energy sources that could be used to replace the power generated by Comanche Peak Units 1 and 2. Commenters also noted that the analysis of energy alternatives should include renewable or sustainable energy options, energy-efficient measures, and energy storage options.

B.1.4 Environmental Justice Comment Summary: Two commenters expressed concern about environmental justice. The Environmental Protection Agency (EPA) recommended that safety information be made available to the public to mitigate impacts to minority and low-income populations within the operational area of Comanche Peak Units 1 and 2. Another commenter expressed concern over environmental and health impacts for indigenous, low-income and communities of color.

B.1.5 Geologic Environment Comment Summary: Several commenters addressed the occurrence and frequency of seismic events at Comanche Peak and the potential effects of a seismic event on the plant.

Commenters are concerned about changes in seismic activity in the Barnett Shale due to hydrologic fracturing from other industries. Commenters are also concerned with risks associated with changes in soil conditions due to drought and erosion of the dam.

B.1.6 Greenhouse Gas Emissions and Climate Change Comment Summary: Commenters requested that the SEIS for the license renewal of Comanche Peak Units 1 and 2 consider climate change impacts and use current climate references. Commenters requested that the SEIS include a discussion on the impacts of reservoir water level changes and rising water temperatures. Commenters raised concerns about the impacts of changing water levels and climate change on future nuclear plant operation.

B.1.7 Historic and Cultural Resources Comment Summary: A commenter expressed concern about radiation releases from Comanche Peak Units 1 and 2 contaminating sacred indigenous springs.

B.1.8 Human Health - Microbiological Hazard Comment Summary: A commenter expressed concern of higher water temperatures from discharge effluents for Comanche Peak Units 1 and 2 leading to increased bacterial growth and increased human health risks.

B.1.9 Human Health - Radiological Comment Summary: Multiple commenters expressed concerns about the health impacts to people living near or upwind of Comanche Peak Units 1 and 2 that could result from exposure to radiation. Commenters expressed concern about whether the SEIS will address risks to women, pregnant woman, children, and infants. Multiple commenters stated that women and children are more at risk of health impacts due to radiation exposure and cited different reports and studies and asked NRC to take those into consideration during the proposed licensing action, or to conduct additional studies. Commenters expressed concern about the availability of radiological monitoring data and the risks to both plant workers and the public posed by radioactive releases. A few commenters stated that the NRC, the applicant, and other agencies need to do more transparent engagement with the public regarding potential health impacts related to radiation releases from the plant. One commenter expressed concern regarding the presence of Carbon-14 in effluents from nuclear reactors.

B.1.10 Hydrology Comment Summary: Several commenters express concern over the potential for surface water contamination from integrity reduction or loss of the earthen dam or changes in soil conditions due to drought for Comanche Peak Units 1 and 2. In particular, commenters requested that the SEIS include a discussion on surface water use conflicts, impacts on surface water quality and risks from climate change such as drought.

B.1.11 Meteorology and Air Quality Comment Summary: Several commenters expressed concerns pertaining to air quality because of increases in air emissions from potential construction, maintenance, and operation activities of Comanche Peak Units 1 and 2. The EPA and commenters request consideration of proposed mitigation measures to minimize emissions.

A commenter asked for plans for economic development of the surrounding area of Comanche Peak Units 1 and 2. A commenter stated that a thorough economic impact report should be done for areas surrounding the plant. A commenter noted positive and negative tax impacts to the area because of the plant.

Commenters stated concerns about the cost to taxpayers for storing the waste as well as the cost and safety concerns in transportation of the waste.

The EPA recommends that the NRC address the applicability of state and federal hazardous waste requirements for the storage of previously accumulated Low Level Mixed Waste. Multiple commenters stated their concerns about the types of storage and transportation of radioactive materials and methods that are being used for managing the radioactive waste.

B.2.2 NRC Review Process - NEPA, 10 CFR 51, and 10 CFR 54 Comment Summary: Commenters stated that EIS should take a hard look at the action and assess all environmental impacts of the action and those, and any reasonable alternatives, be made available for the public to understand. Commenters stated that the NRC should consider climate change and other conditions that will change during the future time frame of the proposed extension to the licenses for Comanche Peak 1 and 2 and those potential impacts on the public well-being. A commenter suggested confirmation bias are prohibitive in the NRC and the applicant doing a full and impartial review of the licensing action.

B.2.5 Aging Management Comment Summary: The following comments express concern about aging components at Comanche Peak, Units 1 and 2, or the ability to effectively manage aging during the period of extended operation. Several commenters express concern over metal embrittlement and cracking. Many commenters express concern over the aging dam. Several comments specifically cite concerns in changes in expected lifetimes of components in changing conditions caused by natural events such as climate change or seismic activity.
