Dear Mr. Tran:

The Region 6 office of the U.S. Environmental Protection Agency (EPA) has reviewed the Nuclear Regulatory Commission (NRC) Federal Register Notice of Intent to prepare an Environmental Impact Statement (EIS), published December 13, 2022, for the license renewal of the Comanche Peak Nuclear Power Plant (CPNPP), Units 1 and 2 located in Somervell County, Texas. The purpose of the CPNPP license renewal is to extend the reactor operating licenses for an additional twenty years beyond the expiration of the current licenses. The current operating license for Unit 1 expires at midnight on February 8, 2030, and the current operating license for Unit 2 expires at midnight on February 2, 2033. The review is pursuant to the National Environmental Policy Act (NEPA), the Council on Environmental Quality (CEQ) regulations (40 CFR Parts 1500 - 1508), and our NEPA review authority under Section 309 of the Clean Air Act.

To assist in the scoping process for this project, EPA has identified several areas for your attention and provides scoping comments for your consideration. EPA is most interested in the Air Quality, Hazardous Waste and Environmental Justice impacts. We offer the following comments for your consideration.

Air Quality Comments EPA recommends the Draft EIS describe and estimate air emissions from potential construction, maintenance, and operation activities, as well as proposed mitigation measures to minimize those emissions.

Hazardous Waste Comments EPA recommends that the NRC address the applicability of state and federal hazardous waste requirements for the storage of previously accumulated Low Level Mixed Waste.

Environmental Justice Comments EPA recommends a continued effort to adhere to all safety regulations to make sure that information is available to the public as to mitigate impacts to minority and low-income populations within the operational area.
