Dear Ms. Marcano:

INTERAGENCY AGREEMENT CLOSEOUT FOR THE PROTECTION OF CLASSIFIED INFORMATION AND RELATED SECURITY ACTIVITIES AT THE CENTRUS ENERGY CORP FACILITY

Reference:

Letter from Mary C. McCune to Andrea Kock, Office of Nuclear Material Safety and Safeguards, U.S. Nuclear Regulatory Commission, Nuclear Regulatory Commission (NRC) -

Department of Energy (DOE) Memorandum of Understanding (MOU) on Protection of Classified Information and Related Security Activities at Uranium Enrichment Facilities , dated September 23, 2020 On September 23, 2020, DOE provided notice of the termination of the MOU between the Nuclear Regulatory Commission (NRC) and the Department of Energy (DOE) on the Protection of Classified Information and Related Security Activities at Uranium Enrichment Facilities and corresponding transition of associated activities, to be effective March 22, 2021. Consistent with DOEs notice of termination of the MOU, this letter provides written notification of closeout and termination of Interagency Agreement (IAA) activities associated with the draft NRC Agreement Number 31310020S0013, between the NRC and DOE for the protection of classified information and related security activities at the Centrus Energy Corp Facility, in accordance with NRC General Terms and Conditions for IAAs. Although the Centrus Energy Corp IAA was never activated, support for the Centrus Energy Corp scope of work was performed through a support contract and, therefore, no charges were placed against the Centrus Energy Corp IAA.

Near term activities outlined in the referenced letter and draft IAA are complete. Transition of remaining tasks, responsibilities and associated authorities specified in the draft IAA, including Authorizing Official for classified IT systems, are the responsibility of the NRC as of the date of this letter. The Department is identifying unexpended funds associated with this agreement for return to NRC in coordination with the designated NRC Contracting Officer Representative and the responsible Regulatory Management Team Leader for Nuclear Fuel Supply as specified in the IAA.
