Safety Review - The initial public hearings were held June 12-15, 1972.

In response to the order of the ASLB dated July 14,1972, the epp11 cant (by letters dated August 18 and Septembe 20,1972) submitted supple-mental data conceming population distribution and related emergency plans for the Newbold Island site. The staff evaluated the impact of these new data on site acceptability and scheduled an ACRS meeting for November.10,1972. On November 3, 1972, that ACRS meeting was postponed pending resolution of the water allocation problem discussed under Environmental Review below.

Further ASLB hearings on health and safety matters are not planned until the ACRS meeting occurs.

Environmental Review - The Draft Envinnmental Statement is scheduled for issue on December 20,1972. During the course of the environmental review it becama increasingly apparent that there was considerable uncertainty regarding the ability of the applicant to obtain a water use allocation from the Delaware River Basin Commission.

In discussions with the DRBC, we learned that the approval of water use permits for both the Limerick and Newbold Island power plants was strongly tied to

. approval of the Tocks Island reservoir project. The Tocks Island project does not presently have the support of the Governors of New York and New Jersey, and its approval appears to be highly uncertain.

Chairman Train of the CEQ, in a recent letter to Chairman Schlesinger dealing with both Newbold Island and Liserick, expressed a desire to

" avoid, if at all possible, any further Federal nettons that might tend to consit us to approval of Tocks Island project in absence of the necessary envimnmental safeguards."
