SUBJECT:
CRITEFIA FOR INDEPENDENCE OF PARTICIPANTS IN IDVP'S In your memo of May 27, 1982, you requested that we evaluate the Teledyne proposal for financial independence of individuals and companies involved in the Diablo Canyon Independent Design Verification Program, and that we develop specific guidelines to be used in assessing reviewer's freedom to explore concerns. We have discussed these issues with your project people working on Diablo Canyon and with the Region V staff and come to the following conclusions:
1.
We consider the independence specified by Teledyne (Cooper's letter of April 5, 1982) to be adequate and in conformance with the Commission's guidelines specified in the Chairman's February 1st letter to Congressman Ottinger.
2.
We believe the criteria for independence of comunication and action as specified recently in Teledyne's Semi-Monthly Report #14 to be acceptable subject to the comments we provided to Mr. Schierling.
If the IDVP is conducted in this manner, we do not believe issues will be withheld from the NRC and the public view.
3.
Although not asked specifically in your memo, we have also considered whether or not guidelines more specific than the Ottinger letter should be set forth for use in other project IDVPs.
I have discussed this with Mr. Denton and it was concluded that the Ottinger letter would be used as a basis and each case would be handled on its own merits. Any requests by DL for review of independence will be processed by DE, otherwise we will assume that the project manager will fulfill this function.
