EXERCISE OF ENFORCEMENT DISCRETION AND NOTICE OF VIOLATION (NRC Letter to the Licensee dated September 17,1997 and Office of Investigations (01) Report Number 3-96-023)
This is to inform the Commission that the staff intends to exercise enforcement discretion per Section VI.8,6 of the Enforcement Policy and not issue a Notice of Violation to Commonwealth Edison for failure to provide complete and accurate information to the NRC. The matter involved oral statements made to the staff concerning reactor building siding at the Quad Cities Station. The Commission was consulted on this action in SECY-98-086 because the NRC staff did not arrive at the same conclusions as those in the Office of Investigation report that reviewed this and other matters. The Commission assented to the staff proposed action on May 13,1998.
1 in addition to the staff exercising discretion, a violation of 50.9 is being cited at Severity Level l
IV for the licensee's failure to provide complete and accurate information conceming the configuration of the residual heat removal comer room structural steel.
It should be noted that the licensee has not been specifically informed of the enforcement action. The schedute ofissuance and notification is:
