NOTICE OF VIOLATION Commonwealth Edison Company Docket Nos. 50-254: 50-265 j Ouad Cities Station, Units 1 and 2 License Nos. DPR-29: DPR-30 During an NRC inspection conducted on October 27 through December 6, 1996, three violations of NRC requirements were identified. In accordance with the

" General Statement of Policy and Procedure for NRC Enforcement Actions,"

NUREG 1600, the violations are listed below:

1. Appendix B of 10 CFR Part 50, Criterion III, " Design Control," requires l in part that measures shall be established for the selection and review

} for suitability of application of parts that are essential to the .

safety-related functions of the structures, systems, and components.

i Contrary to the above, incorrect bolts were used in the 1C and 2C safety-related residual heat removal service water (RHRSW) low pressure i pumps. The incorrect Grade B8 replacement bolts had lower yield strength than was required for use in the pumps during the period 4

' October 8 through October 27, 1996, for the 1C RHRSW pump and July 12 through October 28, 1996, for the 2C RHRSW pump and caused the pumps to j be inoperable.

2. 10 CFR 50.73 Section (a)(2)(I)(B) " License Event Re) ort System,"
requires the licensee to report.any condition prohi)ited by the 31 ant's
Technical Specifications within 30 days after the discovery of t1e 4

event.

) Contrary to the above, on October 25, 1996, the licensee discovered that

! Unit 2 had been operated in a condition prohibited by plant Technical

Specifications 3.5.B.2 and 3.5.B.5. Specifically, between July 12 and J

October 25, 1996, Unit 2 was o)erated for a period in excess of 30 days

with the 2C RHRSW pump inopera)le (see Item 1 above), a condition i i )rohibited by Technical Specifications. The licensee failed to report Jy November 24, 1996, the discovery that Unit 2 had operated beyond the l Technical Specification allowed 30 days.

This is a Severity Level IV violation (Supplement I).

part, "A test 3rogram shall be established .. . and performed in accordance wit 1 written test procedures which incorporate the i requirements and acceptance limits contained in applicable design documents."

licensee used to ensure TS requirement 4.8.D.4 was met.  !

operation.

Pursuant to the provisions of 10 CFR 2.201, Commonwealth Edison is hereby required to submit a written statement of explanation to the U.S. Nuclear Regulatory Commission ATTN: Document Control Desk, Washington D.C. 20555 ,

with a copy to the Regional Administrator, Region III, and a co)y to the NRC Resident Ins)ector at the facility that is the subject of this lotice, within

, 30 days of tie date of the letter transmitting this Notice of Violation (Notice). This reply should be clearly marked as a " Reply to a Notice of Violation" and should include for each violation: (1) the reason for the violation or, if contested, the basis for disputing the violation, (2) the corrective steps that have been taken and the results achieved. (3) the corrective steps that will be taken to avoid further violations, and (4) the date when full compliance will be achieved. Your response may reference or  :

include previous docketed correspondence, if the correspondence adequately addresses the required response. If an adequate reply is not received within the time specified in this Notice, an order or a Demand for Information may be issued as to why the license should not be modified, suspended, or revoked, or why such other action as may be proper should not be taken. Where good cause is shown, consideration will be given to extending the response time.
