SUBJECT: NRC COMBINED INSPECTION 50-245/97-208:50 336/97 208:423/97 208

and NOTICE OF VIOLATION

On December 31,1997, the NRC completed an inspection at Millstone Units 1,2 & 3

roactor f acilities. The enclosed report presents the results of that inspection.

During the month-long period covered by this inspection, your conduct of activities at tha

Millstone facilities was generally characterized by safety-conscious operations with a focus

on controlling shutdown risk, comprehensive corrective action activities aimed at both unit

recovery and response to NRC Significant items List (SIL) issues, and continued

engineering efforts in support of configuration management program improvements.

However, our inspection identified two violations of NRC requirements, in the first

instance, NRC inspectors identified the failure to restrain temporary equipment located near

safety-related equipment in the Unit 2 control room. The second violation involves overlap

surveillance testing of safety-related logic circuits at Unit 3. This is a concern because

previous procedure reviews did not ensure all technical specification requirements were

being met, resulting in additional problems being identified by the NRC.

These violations are cited in the enclosed Notice of Violation, and the circumstances-

surrounding the violations are described in detail in the enclosed report. Please note that

you are required to respond to this letter and should follow the instructions specified in the

enclosed Nctice when preparing your response. The NRC will use your response,in part,

to determine whether further enforcement action is necessary to ensure compliance with

regulatory requirements. Furthermore,in addition to the enclosed enforcement actions,

your attention is directed to specific areas in each of the three units.

At Unit 3, the NRC review of SIL closure packages continues to confirm a deliberate and

generally comprehensive approach on the pan of your staff to complete and validate the

effectiveness of corrective measures. However, we remain concerned that several

procedures still require reasion and that personnel training, particularly for your licensed

operators, has been delayed by the completion of plant modifications, procedural changes,

and other program erihancements stillin progress. We note that SIL items remain open in

the areas of procedure adequacy, fire protection, operator training, and overall corrective

action effectiveness.- Your specific attention to these areas is needed to ensure the

readiness for our planned inspection ef forts.

At Unit 2, note that you continue to identify degradation in the service water system piping

internal protective coatings. Clear understanding of the cause is essential to the long term

resolutien of the problems. Additionally, we will continue our evaluation of your progress

in addressing concerns related to the Significant items List issue associated with the

Material, Equipment, and Parts Lists (MEPL) program, in particular, the NRC found that

you have not yet fully developed broader corrective actions to address past instar.ces

where non-safety-related parts were inappropriately installed for parts that were classified

as " Undetermined" or "Non Safety-Related" and had no MEPL evaluations. Renewed

management attention to address MEPL program concerns is warranted.

At Unit 1, we recognize that there will be a further reduction in testart activities on the unit

through the end of 1998. We also understand that you plan a reduction in Unit 1

a

personnel to provide support for the ongoing restart efforts at Units 2 and 3. It is expected

that you will continue to ensure that the remaining Unit 1 personnel focus their efforts on

performing the appropriate corrective and preventive maintenance in support of maintaining

the plant in a safe shutdown condition. Additiontily, specific attention should be placed on

ensuring that plant systems not requked for safe shutdown are placed in a condition

conducive to a long term shutdown.

In accordance with 10 CFR 2.790 of (ne NRC's " Rules of Practice," a copy of this letter

and its enclosures will be placed in the NRC Public Document Room (PDR),
