l NOTICE OF VIOLATION Siemens Power Corporation Docket No.: 70-1257 Richland, Washington License No.: SNM-1227 During an NRC inspection conducted on April 14-18, 23-24 and May 1,1997, one violation of NRC requirements was identified. In accordance with the " General Statement of Policy and Procedure for NRC Enforcement Actions," NUREG-1600, the violation is listed below:

10 CFR 71.16 (a) issues a general license to any licensee of the Commission to transport or deliver to carrier for transport, licensed materialin a package the design of which has been approved in a foreign national competent authority certificate that has been revalidated by DOT provided that (in part) the licensee complies with the terms and conditions of the certificate and revalidation.

Item a., Section 4, " General Conditions," of Competent Authority Certification Certificate USA /0442/AF-85, Revision 3, dated January 17,1996, (in effect at the l time) required each user of this certificate to maintain this certificate and all documents necessary to properly prepare the package for transportation with the endorsed certificate.

Section A.1.1, " Fuel Loading," of Chapter IV, Handling Procedures and Maintenance of Packages including Nuclear Fuel Materials," dated July 1993, approved with the above certificate requires that cushioning materials be used to prevent shifting of contents during transport.

Contrary to the above, on June 3,1996, the licensee shipped 405 NT IX shipping packages containing fissile material without installing cushioning material.

This is a Severity Level IV violation (Supplement V).

Pursuant to the provisions of 10 CFR 2.201, Siemens Power Corporation is hereby required to submit a written statement or explanation to the U.S. Nuclear Regulatory Commission, ATTN: Document Control Desk, Washington, D.C. 20555 with a copy to the Regional Administrator, Region IV,611 Ryan Plaza Drive, Suite 400, Arlington, Texas 76011, and the Walnut Creek Field Office,1450 Maria Lane, Walnut Creek, California 94596, within 30 days of the date of the letter transmitting this Notice of Violation (Notice). This reply should be clearly marked as a " Reply to a Notice of Violation" and should include for each violation: (1) the reason for the violation, or, if contested, the basis for disputing the violation, (2) the corrective steps that have been taken and the results achieved, (3) the corrective steps that will be taken to avoid further violations, and (4) the date when full

< compliance will be achieved. Your response may reference or include previous docketed

( correspondence, if the correspondence adequately addresses the required response.
