J As a result of the State of Washington inspection of Exxon Nuclear Company's
]
waste shipment number H-1116 received at the U.S. Ecology's burial f acility near Richland, Washington on June 27, 1985, the NRC review of the inspection

report, and in accordance with the NRC Enforcement Policy (10 CFR Part 2, 1
Appendix C), the following violation was identified:

10 CFR 71.5 incorporates by reference Department of Transportation regulations in 49 CFR Parts 170-189.
49 CFR 173.425(b) (1) requires that materials must be packaged in strong, tight packages so that there will be no leakage of radioactive material under conditions normally incident j
to transportation.
J Contrary to the above, at the time of the State inspection, one container in the shipment (Container Number D-17276) was identified to have a 3
j visible hole near the bottom of the container. There was no loose radioactive contamination on the surface of the container.

This is a Severity Level IV Violation (Supplement V).
i Pursuant to the previsions of'10 CFR 2.201, Exxon Nuclear Company is hereby required to aiubmit to this office within 30 days of the date of this Notice, a written statoment or explanation in reply, including (1) the corrective steps

which have been taken and the results achieved; (2) corrective steps which I
will be taken to avoid further items of noncompliance; and (3) the date when full compliance was or will be achieved. Consideration may be given to extending your response time for good cause shown.
