NRC INSPECTION REFORT 70-1257/97-04 AND NOTICE OF VIOLATION .

Dear Mr. Femreite:

This refers to the inspection conducted on April 14-18,1997, at your Siemens Power Corporation facility. An exit briefing was conducted with you and other members of your i

staff at the conclusion of the onsite inspection. The inspection also included followup in-office review and discussions with the Department of Transportation (DOT) on April 23 and 24 to resolve an issue identified during the onsite portion of the inspection. The results of our deliberations with the DOT were discussed by telephone with members of l you staff on May 1,1997. The enclosed report presents the scope and results of this

! inspection.

During the inspection, your conduct of activities at the Siemens f acility was generally I characterized by implementation of effective programs in the areas of operations review,

i radioactive effluent discharges, environmental protection, and solid radioactive waste j management. Severalissues related to transportation of radioactive materials were identified including one violation related to transportation activities, an unresolved item involving mass limits for packages, and an issue involving the maintenance of procedures affecting transportation. These matters indicate a need for increased management involvement and oversight of your program for shipping fissile material.

The violation is cited in the enclosed Notice of Violation (Notice) and the circumstances surrounding this vio'ation are described in detailin the enclosed report. You are required to respond to this letter and should follow the instructions specified in the enclosed Notice when preparing your response. For your consideration and convenience, an excerpt from NRC Information Notice 96-28, " SUGGESTED GUIDANCE RELATING TO DEVELOPMENT AND IMPLEMENTATION OF CORRECTIVE ACTION." The NRC will use your response, in part, to determine whether further enforcement action is necessary to ensure compliance with regulatory requirements.

In accordance with 10 CFR 2.790 of the NRC's " Rules of Practice," a copy of this letter, I its enclosures, and your response will be placed in the NRC Public Document Room (PDR), {(
