NOTICE OF VIOLATION Randall L. Rumley lA 97 071 During an NRC investigation completed July 31,1997, a violation of NRC requirements was identified, in accordance with the " General Statement of Policy and Procedure for NRC Enforcement Actions," NUREG 1600, the violation is listed below:

10 CFR 70.10 states, in part, that any licensee or any employee of a licensee may not engage in deliberate misconduct that causes or, but for detection, would have caused a licensee to be in violation of any rule, regulation, or order, or any term, condition, or limitation of any license issued by the Commission. Deliberate misconduct includes, in part, an intentional act or omission that the person knows:

1) would cause a licensee to be in violation of any rule, regulation or any term, condition, or limitation of any license issued by the Commission; or 2) constitutes a violation of a procedure.

Safety Condition S 1 of License SNM 1227 (Siemens Power Corporation) authorizes the use of licensed materials in accordance with the statements, representations, and conditions contained in Part I of the licensee's application dated October 28, 1996, and supplements and revisions thereto.

Section 2.5, " Operating Procedures, Standards and Guides," Part I, of the license application states, in part, that the licensee is committed to <:ontrolling activities in accordance with Standard Operating Procedures, Company uandards and Policy Guides.

Section 4.8, " Airborne Radioactivity Area," Chapter 2, " Radiation Protection Standards," of Siemens Safety Manual (EMF-30) states, in Part, under " Survey Requirements," that continuous sampling for airborne particulate radioactivity shall be provided that is representative or adjusted to be representative of the air in the breathing zone of the personnel, item 5, Appendix 9, " Criticality Safety Rules," Chapter 3, " Criticality Safety Standards," of Siemens Safety Manual (EMF-30) states, "Never transfer or receive material without knowing the condition and contents of each container involved."

ltem 9, page 4 under " Restricted Areas," of Radiation Work Procedure P91,001 requires, in part, that dumping and opening of uranium powder containers be performed in a ventilated enclosure.

Item 6.4, Section 6.0, " General Operator Tasks," of Standard Operating Procedure P66,1035, " Ceramic Operations General Rules," states "Do your job correctly, and completely-no shortcuts or work arounds are acceptable and will not be tolerated."

Contrary to the above, on April 13,1997, Randall L. Rumley, a lead operator, while performing duties in the gadolinium fuel pellet pressing area and being aware of the above stated requirements: (1) defeated a breathing zone air sampler by placing a rubber glove over the air sampler at the respective work station, (2) transferred an unknown (uncertain weight) quantity of low enriched uranium powder from a 9709170152 970912 PDR ADOCK 07001257 l C PDR 1

2-container into another container of enriched uranium powder, and (3) transferred the same without using a ventilated enclosure. Mr. Rumley's actions caused the licensee to be in violation of the above procedural requirements.

This is a Severity Level lli violation (Supplement Vil).

  • Pursuant to the provisions of 10 CFR 2.201, Randall L. Rumley is hereby required to submit a written statement or explanation to the U.S. Nuclear Regulatory Commission, ATTN: Document Control Desk, Washington, D.C. 20555, with a copy to the Regional Administrator, Region IV, within 30 days of the date of the letter transmitting this Notice of Violation (Notice). This reply should be clearly marked as a " Reply to a Notice of Violation" and should include for each violation: (1) the reason for the violation, or, if contested, the basis for disputing the violation, (2) the corrective steps that have been (taken and the results achieved, (3) the corrective steps that will be taken to avoid further ,

-violations, and (4) the date when full compliance will be achieved. Your response may reference or include previous docketed correspondence, if the correspondence adequately addresses the required response, if an adequate reply is not received within the time specified in this Notice, an order or a Demand for Information may be issued as to why the i-license should not be modified, suspended, or revoked, or why such other action as may be proper should not be takei. Where good cause is shown, consideration will be given to extending the response time.

Under the authority of Section 182 of the Act,42 U.S.C. 2232, this response shall be submitted under oath or affirmation.

Because your response will be placed in the NRC Public Document Room (PDR), to the extent possible, it should not include any personal privacy, proprietary or safeguards information so that it can be p; aced in the PDR without redaction. If personal privacy or proprietary information is necessary to provide an acceptable response, then please provide a bracketed copy of your response that identifies the information that should be protected and a redacted copy of your response that deletes such information, if you request withholding of such material, you mnt specifically identify the portions of your response that you seek to have withheld and provide in detail the bases for your claim of withhold-ing (e.g., explain why the disclosure of information will create an unwarranted invasion of personal privacy or provide the information required by 10 CFR 2.790(b) to support a request for withholding confidential commercial or financial information). If safeguards information is necessary'to provide an acceptable response, please provide the level of protection described in 10 CFR 73.21.
