Dear Mr. Keppler:

This letter is to serve as notification of a 10 CFR Part 21 defect which has been identified by the Toledo Edison Company. This situation is con-sidered a defect under the provisions of 10 CFR 21.3(d)(1). The items covered by this report are intended for installation into Davis-Dessa Nucicar Power Station Unit No. 1.

As part of Toledo Edison's purchase order number 043-Q-75561-Ril to West-inghouse Electric Corporation, Jackson, Michigan, the Westinghouse Chicago facility, located at 3900 West 41st Street, Chicago, IL 60832, is to supply Toledo Edison with 49 various replacement itema for Motor Control Centers (MCCs) originally supplied to Toledo Edison by Westinghouse.

The purchase order specifies "All new components must be exactly the same or equivalent to and physically interchangeable with the existing compon-ents in the Motor Control Centers. They must be qualified Class IE Units and should not in any way degrade the qualification of the Motor Control Centers bought originally".

The original construction phase purchase order for the McCs specifies that the MCCs are seismically qualified. To date, Westinghouse, Chicago, has certified the replacement items which have been shipped as meeting all customer requirements.

On May 22-23, 1984 Toledo Edison Quality Enginearitig audited the Westing-house documentation packages supporting the Certificate of Conformances submitted with the replacement parts. Four (4) out of the nino (9) items sampled could not be substantiated no being " exactly the same or equivalent to and physically interchangeable with" the original MCC components. Spe-citically, evidence that these four itema were seismically qualified was not available.

~ review the documentation for all items sent to Toledo Edison under this purchase. order to determine if any other items have been sent to Toledo Edison that cannot be substantiated as being " exactly the same or equiva-lent to and physically interchangeable with" the Class 1E MCCs at Toledo Edison.

Concurrently, Toledo Edison is taking steps to determine the location of all items received on this purchase order. The-appropriate nonconformance procedures will be followed until resolution of this problem.

This situation was determined to be reportable under 10 CFR 21 on May 29, 1984, during a review of the May 22-23, 1984 audit results. This letter confirms a conversation between your Mr. N. Jackiw and Toledo Edison's Messrs. L. Mominee and R. Peters.
