THE CLEVELAND ELECTRIC ILLUMINATING COMPANY DAVIS-BESSE NUCLEAR POWER STATION. UNIT N0. 1 DOCKET NO. 50-346

1.0 INTRODUCTION

During a November 1936 emergency preparedness inspection at the Davis-Besse l Nuclear Power Station, Unit No. 1 (see Inspection Report 50-346/96-11 dated January 6, 199/), the NRC determined that Toledo Edison Company, Centerior Service Company, and The Cleveland Electric Illuminating Company, ,

the licensees for Davis-Besse, had deviated from a commitment to provide a >

backup emergency operations facility (E0F) for the site. a letter dated February 21, 1997, as part of its corrective actions, the licensees proposed to either establish a backup EOF meeting the requirements of Supplement 1 to NUREG-0737 or submit a request to the NRC to allow the use of an alternato location (alternate EOF) in lieu of a backup E0F. By letter dated May 1, ,

1997, as supplemented and amended by letters dated July 21, 1997, and i April 14, 1998, and by facsimile dated March 18, 1998, the licensees submitted a request to the NRC for approval of an alternate EOF location.

2.0 REGULATIONS AND CRITERIA The licensees' proposal was evaluated using the fellowing regulations, cr;teria, and Commission guidance. i

(3) Arrangements for requesting and effectively using resources have been made, arrangements for accommodating State and local staff at the licensee's near-site Emergency Operations Facility have been made, and other organizations capable of augmenting the planned response have been identified.

(8) Adequate emergen;y facilities and equipment to support the emergency response are provided and maintained.

Apoendix E. Subsection IV.E of 10 CFR 50 Adequate provisions shall be made and described for emergency facilities and equipment, including:

(8) A licensee onsite technical support center [TSC) and a licensee near-site emergency operations facility from which effective direction can be given and effective control can be exercised during an emergency; HUREG-0737 Sunclement 1. Section 8.4.1. "Emeraency Operations Facility (EOF)." specifies, in part, that the E0F will be:

b. Located and provided with radiological protection features as described in Table 1 (previous guidance approved by the Commission) and with appropriate radiological monitoring systems.

Table 1 includes two options. Option 1 provides for a primary EOF located within 10 miles of the site with specific radiological protection features and a backup E0F located within 10 to 20 miles of the site. Option 2 provides for a single EOF located within 10 to 20 miles of the site.

SECY-96-170. " Assessment of Exceptions Granted for locations and Staffina Times of Emeraency Doeration Facilities." describes the process and criteria used in evaluating exceptions to the two options provided in NUREG-0737, Supplement 1. One of these exceptions concerns the use of a close-in hardened E0F (within 10 miles of the plent) with an Alternate EOF (in lieu of a backup EOF). In the NRC memorandum from S. Chilk to W. Dircks, "SECY-81-509 - NUREG-0696 Criteria for Emergency

( Operations Facilities for Nuclear Power Reactors," dated September 30, 1981 (the Chilk/Dircks 1981 memorandum), the Commission stated that the staff could accept close-in hardened E0Fs provided the emergency plan identified an alternate location where utility and government officials can meet and have contingency arrangements for communications to the TSC.

3.0 EVALUATION The primary E0F at Davis-Besse is located in the Administration Building (DBAB), which is located at the plant site. The DBAB is designed to meet the

- requirements of Criterion 19 of Appendix A to 10 CFR Part 50. That is, the DBAB provides for occupancy without exceeding 5 rem whole body exposure (or l its equivalent'to any part of the body) for the duration of an accident.

In a letter dated May 21, 1981, Toledo Edison described the radiation protection design and habitability features of the emergency response facility areas of the DBAB.- These features include shield walls and ventilation-

systems that provide high-efficiency filtration and adsorption of airborne radioactivity. In the Chilk/Dircks 1981 memorandum, the Davis-Besso E0F was described as a fully hardened E0F within the 10-mile emergency planning zone with protection factors in excess of 100 and ventilation systems which will assure a habitable facility even during a core melt accident.

In addition to the primary EOF, the licensees are establishing an alternate l EOF to provide a meeting room to conduct technical briefings with offsite agency officials using current plant data and to communicate directly with-senior management personnel in the TSC and Emergency Control Center. The alternate EOF is located 18 straight-line miles-from Davis lesse at the Training Center at the Bay Shore Station in Oregon, Ohio. The alternate EOF has the following features.

Seating capacity for approximately 30 individuals Access to the Company's Centrex telephone system Equipment and supplies to support emergency response (for example, a facsimile machine and copies of the emergency preparedness plan and the procedures). .

The licensees have informed State and local government agencies within the plume exposure emergency planning zone of their intent to use the Bay Shore Station Training Center as an alternate EOF location.

4.0 CONCLUSION

The staff has determined that the licensees' proposal meets the guidance for acceptable excepticas for EOFs provided by the Commission in the Chilk/Dircks 1981 memorandum because the Davis-Besse primary EOF is sufficiently hardened ,

._4-and the alternate EOF (located between 10 and 20 miles of the site) is a facility where utility and government officials can meet and has provisions for communications with the TSC. Therefore, the staff concludes that the requested exception from the EOF criteria provided in NUREG-0737, Supplement 1 is acceptable.
