Dear Mr. Reynolds:
This is in partial response to your letter dated March 14, 1983 in which you requested, pursuant to the Freedom of Information Act, records relating to the Office of Inspector and Auditor's review of the NRC investigation reported in NUREG-0862 and for other files concerning OIA investigations related to the Diablo Canyon Nuclear Power Plants.
The documents listed on Appendix A are being placed in the NRC Public Document Room, 1717 H Street, N.W., Washington, DC.
Access may be obtained to these documents by writing to the NRC Public Document Room (PDR),1717 H Street, N.W., Washington, DC 20555.
The charge for records maintained at the PDR is five cents ($0.05) per page, as specified in 10 CFR9.14(a). Upon your agreement to pay the copying charges, the PDR will arrange for the documents to be copied by a private contractor servicing the PDR.
You will be billed by the contractor for the copying charges plus tax and postage.
Also subject to your request is a July 30, 1982 memorandum transmitting the Ronald Smith draft memorandum with nine (9) attachments which se subject to your request. A copy of the transmittal memo and attachments 1, 2, 3, and 8 are also being placed in the PDR.
These are described respectively as documents 31, 32, 33, 2, and 34 of Appendix A.
Attachments 4, 5, 6, 7, and 9 are analyses of evidence and allegations which were developed as part of the Office of Inspector and Auditor's deliberative proci2s in preparing a report to the Commissioners.
These attachments are described on Appendix B.
These analyses and the Ronald Smith draft memorandum are being withheld from public disclosure pursuant to Exemption 5 of 'he Freedom of Information Act (10 CFR 552(b)(5)) and 10 CFR 9.5(a)(5).
Factual portions in the draft memorandum and analyses are inextricably in'tertwined with the writer's opinions and conclusions.
There are no reasonably segregable factual portions. Most factual portions in the drafts are already in the public domain as part of NUREG-0862 or in records released in response to this request.
Pursuant to 10 CFR 9.15 of the Commission's regulations, it has been determined that the information withheld is exempt from production or disclosure and that its production or disclosure is contrary to the public interest.
