SUBJECT:

JUSTICE REQUEST REGARDING DIABLO CANYON Today I discussed the Justice request with Brad Whitman, who is Deputy Chief, Pollution Control Unit in the Lands Division. As you know, Whitman is the man who wrote the North Anna memo that was publicly released.

I thought it would be a good idea to start with him because he is familiar with the functions of NRC and my office.

I told Brad that we had three imediate questions that called for i

resolution, namely:

1.

Are we going to see the letter sent in by the complainant?

2.

Can we advise the ASLB of the situation (I expressed a view that NRCwantedto)?

3.

We needed a clearer definition of the " complete report" that Justice was requesting of NRC. On this one I explained the various i

options involved.

Brad was home at the time but he thought.that these were questions that required immediate resolution.

His reaction was that we should have a copy of the letter and the Board probably should be advised of the situation.

I am to call him Friday morning at which time we should get an answer on getting a copy of the letter and advising the Board. He also said he should have a better picture of what they expect from NRC by way of a report.

In the meantime, Brad believes we are on the right track in developing a chronological history of the matter within the agency.
