EEFERRAL OF ALLEGATICN FROM R. MICKY 00W Enclosed is a copy of the letter addressco to the Secretary of the Commission dated May 17, 1991, which purports to respond to a subpcena issued by rne to Mr. Dow cn May 10, 1991 (copy enclosed). As noted in Mr. Dcw's letter, he alleges " duplicity and compromise between Fegion IV ano TV Electric, as well as the civilian crganization known as C.A.S.E."
Mr. Ecw has for several weeks now been claiming that he has relevant information of a safety-related nature. Hcwever, in spite of repeated recuests from this office that he furnish sucn information so that we inay look into it, he has not done so. On April 19, l991, Mr. Dow was interviewed on the recorc in the hope that we might obtain the infcrmation he claims to have. A copy of the transcript of that interview, is also enclosed.
Throughout the transcript, Mr. Dow repeatedly denies having any specific knowledge about anythir.c of interest to the hKC. He only makes references to a vague general belief that "there would have to be" some ERC saf ety concerns in the material that he has. He did make reference to an allegea trislabeling problem at the Unit Cne reactor. However, again, he could give no specifics other than to say that he just knows that it tas occurred. Nevertheless, we are concucting a sampling of labelea items to see if a prcblem can be detected.
At one point, on page la in the transcript, Mr. Cow did make vague references to the NRC ar.d Comancne Peak alleviing the " status cuo" to continue, lie said.
"In cther worcs. it ain't broke yet, we'll hope that it doesn't break and ease it through." While this appears to be a rion-proDiem, when asked if he hac specifics. he answered in the negative.
