Dear Mr. Dow:
In accordance with my letter to you dated July 23, 1991, the date for compliance with the subpoena issued to you for the production of certain documents in your possession, custody, or control, including 16 tapes of calls received by the central switchboard at the Commanche Peak Station, was September 4,
1991.
You are currently in noncompliance with the subpoena and based upon your te'.ephone discussion of August 30, 1990, with Mr. Stephen Lewis, it does not appear that you are taking steps to bring yourself into compliance with the subpoena.
Nevertheless, for reasons discussed below, the NRC staf f is exercising its discretion to forebear from taking any steps to seek enforcement of the subpoena until September 16, 1991.
This forebearance is based upon the request of Ernest Hadley, Esq.,
with whom we understand you have discussed compliance with the subpoena, insofar as the subpoena relates to the tapes.
Acting as an intermediary, Mr. Hadley has had discussions with the staff regarding an agreement under which you would provide the tapes to him.
He would then have them transcribed at the Commission's expense, and the tapes would be returned to you.
This agreement, of course, would be subject to your approval.
Since you indicated in your August 30th discussion with that you were not considering entering into such an agreement, we contacted Mr. Hadley to ascertain the status of his participation in this matter.
He advised Mr. Mullins of this of fice that he would be in contact with you on this matter and requested that we hold off on any ef forts to seek enforcement of the subpoena for a reasonable time to enable him to receive your response. To accommodate Mr. Hadley's request, 9309220020 930420 s

the staff agreed that it would not undertake any efforts to seek enforcement of the subpoena before September 16, 1991.
Although you are in noncompliance with the subpoena, we encourage you to promptly take steps to bring yourself into compliance by producing all tapes and documents subject to the subpoena.
We are willing to entertain any reasonable suggestions from you as to how this may be accomplished by September 16th.
