The budget is then reviewed in turn by the Budget Review Group (an internal group Chaired by the Deputy Executive Director for Operations), the Executive Dir2ctor for Operations and the Commission.
After the Commission budget is approved by the President, it is reviewed by the following five Subcommittees of Congress:

O 4.0 PERSONNEL POLICIES AND ADMINISTRATION 4.1 Nature and Tenure of Authority to Major Positions Attached is a list of major positions in the Nuclear Regulatory Commission.
The list indicates by organization the title, type, appointing authority and tenure of the major positions.
The following notes clarify notations on the list:
(1) The Chairman serves in that office at the discretion of the President.
His/Her tenure on the Commission is five years, as in the case of other Commissioners.
(2) The expression "SES Career /Non-Career" under " type of appointment" indicates that the position in question is an SES General position and may be filled by either a career or non-career appointee. NRC is presently authorized seven non-career appointments and has exercised two of these authorities (General Counsel, and Deputy Executive Director for Operations).
(3) The term " indefinite" is used to describe the tenure of incumbents of Senior Executive Service positions. An individual's tenure in each specific position is at the discretion of the appointing authority. The majority of NRC's SES executives have personal career. tenure in the Senior Executive Service and may be assigned, but have no right to, any particular SES position.
(4.) The Chairman'of the Advisory Committee on Reactor Safety (ACRS) serves a one-year term as Chairman. The tenure of members of the Committee is four years.

1 4.2 Conflict of Interest Restrictions Designated senior officials (NRC-GG-]L 18-SES's and Executive levels) are subject to post-employment restrictic
,rth in the Ethics Government Act of 1978 including one year ban on co.ittm.ing NRC officials with intent to influence agency action for one year following termination of NRC employ-ment.
NRC employees who have input into the decisionmaking process (including Commissioners) are prohibited (including their spouses, minor children, and other members of the immediate household) from owning stocks, bonds, or other security interests in specified entities related to the nuclear industry.
Commissioners - Section 201(e) of the Energy Reorganization Act provides that no Commissioner shall engage in any business, vocation, or employment other than serving as a member of the Commission.
4.3 Compensation and Benefits The U.S. No-'eer Regulatory Commission has three pay categories for key positions;
..ich are Executive Level, SES,supergrade or equivalent. The Executive Level positions, EX2/EX3 are compensated at 560,662 and $55,388 respectively. All SES and supergrade or equivalent positions are compen-sated at the maximum payable rate of 550,112.50 with the exception of four SES Office Director positions which receive 552,750 (due to the level IV status prior to SES Conversion).
All key positions are covered under the Civil Service Retirement System and Regular Federal life insurance and Health Benefits plans. The SES positions are also allowed unlimited accrued annual leave.
4.4 Supporting Services Each Commissioner is provided with a personnal staff of approximately five enployees who serve at his/her pleasure.
Commissioners, the Executive Director for Operations and major program office Directors are provided local transportation as required to discharge official functions.

Direct a program relating to regulatory relationships with State and local governments and interstate agencies. Serves as liaison with other Federal agencies having functional or operational State and interstate responsibilities.
o Administer the State Agreements program, pursuant to Section 274 of the Atomic Energy Act of 1954, as amended, whereby qualified States assume responsibility for the regulation of certain nuclear materials.
o Provide training for State and local government personnel in radio-logical health, and regulatory practices and procedures.

Together with the Bureau of Radiological Health of The Department of o
Health and Human Services and the Office of Radiation Programs of the Environmental Protection Agency, the NRC continued its financial and technical assistance to the Conference of State Radiation Control Program Directors. The conference, composed of heads of State radiological health programs, seeks to promote and coordinate State radiological health activities.
Eight States have contracts with NRC that are jointly funded by URC o
and D0T for the surveillance of radioactive materials transportation.
We are now moving toward contracts under which the States will enforce NRC and 00T regulations.
(States are Florida, Georgia, Illinois, Maryland, Michigan, Nevada, South Carolina, and Washington.)
o NRC has Memoranda of Agreement with seven States providing for l
general cooperation in matters of mutual interest including water quality, siting, resident inspector programs, protection of infor-mation and environmental assessment.
o The Governors of all States have appointed liaison officers to maintain direct communication with NRC. A meeting of this group is planned for December 9 and 10, 1980.
Through the Office of State Programs, the Commission maintains com-o munication with national and regional State organizations such as The National Governors' Association, The National Conference of State Legislatures, The Southern States Energy Board, The Western Inter-state Energy Board and The National Association of Counties.
o At the request of the Office of State Programs, NRC's Office of Research has contracted with The New England Regional Commission to develop an integrated regional approach to energy facility siting.
o The NRC provided technical assistance in 1980 to California, Colorado, Arizona, New Mexico, Oregon, Texas, and Washington in the licensing and regulation of uranium recovery operations. This inicuded 21 l
project reviews, covering uranium mills, heap-leach operations, solution-mining operations, and research and development activities.

o The Chairman of NRC sits in at meetings of the State Planning Council, created by the President, and including 15 Governors and other elected officials, to work with the Executive Branch and the Congress on Waste Management decisions and actions. Because NRC is an independent regulatory agency, the Chairman of NRC does not vote on SPC recommendations.
o NRC is continuing research in support of State licensed low-level waste disposal activities, including long-term erosion, hydrology, and trench cap studies.
o In response to the recently signed Public Law 96-295, NRC is develop-ing regulations which will require shippers to notify Governors of shipment times and routes prior to each shipment of specified waste through the State.

8.0 Legislative Processes

Oversight Comittees affecting NRC activities.
There are four Subcomittees that maintain general jurisdiction over NRC's regulatory activities.
In the Senate, the Subcomittee on Nuclear Regula-tion of the Committee on Environment and Public Works has jurisdiction over domestic nuclear regulatory activities.
In the House, this juris-diction is shared by the Subcomittee on Energy and the Er.vironment of the Comittee on Interior and Insular Affairs and the Subcomittee on Energy and Power of the Comittee on Interstate and Foreign Comerce. By agree-ment, the Interior Comittee has " primary jurisdiction with respect to legislation that deals principally with nuclear licensing and with safety regulation of nuclear facilities." The Commerce Comittee has "concurreat jurisdiction over many of these matters." The remaining Subcommittee with oversight over NRC matters is the Subcommittee on the Environment, Energy and Natural Resources in the House Comittee on Government Operations.
These four subcomittees succeeded the Joint Committee on Atomic Energy, which was abolished by statute in 1977.
Under the Atomic E Pgy Act of 1954, as amended, NRC must continue to keep these four subcommittees fully and currently infomed as to NRC activities.
In addition to these four subcomittees which have general responsibilities for nuclear regulation, matters concerning the international aspects of atomic energy fall within the respective jurisdictions of the Senate Com-(
mittee on Foreign Relations and the House Comittee on Foreign Affairs.
In the Senate, the Comittee on Governmental Affairs shares responsibili-ties with the Foreign Relations Committee for the organizdo. ad manage-ment of United States nuclear export policy and international safeguards.
o NRC Office Functions Related to Legislative Processes Existing, pending, or proposed legislation and correspondence affecting the NRC is coordinated among several offices. These include:
Office of Congressional Affairs (OCA)
Provides the Chairman, other Comissioners, the dxecutive Director for Operations, Directers of Offices and Divisions, and other NRC staff with advice and cocSel concerning relations with Congress.
Carries on liaison with Congressional comittees, and individual Members of Congress with respect to matters of interest and con-cern to NRC.
Monitors all legislative proposals, bills, Congressional hearings, debates and other activities of potential interest and concern to NRC and advises the Chairman, other Comissioners and the Staff, as appropriate.
Reviews Congressional correspondence and testimony for complete-('
ness, responsiveness and readability.

Office of Secretariat (SECY)
Responsible for the routing of all Congressional correspondence and maintains a control system of Congressional communications as with other correspondence addressed to the Commission.
Office of General Counsel (0GC)
Represents and protects the interests of the NRC in relation to other Government committees of Congress, foreign governments, or members of the public.
Coordinates with appropriate officials of the NRC and prepares legislative material with which NRC is concerned, including legislation initiated by the NRC and legislation submitted to the NRC for comments.
Executive Director for Operations (EDO)
-- The EDO controls all Congressional correspondence assigned to the offices under his jurisdic. tion.
Under the EDO the Controller Develops the agency's budget for submission to Congress x
along with suggested language for the authorization and appropriation bills.
Participates with Committee staffs on additional requests for information affecting the budget submission.
-- Maintains fiscal control on any funding restrictions related to the authorization bill.
Also for the EDO the Office of Management and Program Analysis prepares publications requested by the Congress, such as the Agency's Annual Report and the Quarterly Report on Abnormal Occurrences.

10.0 R_e_ organization Plan No. l_of 19_8_0 Background and Provisions of Plan The Plan, proposed by the President and allowed by the Congress, seeks to correct structural deficiencies in NRC leadership identified by tho various investigations into the Three Mile Island accident. The Plan strengthens the NRC Chairman's role relative to the Commission and the Executive Director for Operations' role relative to the program staff.
Pertinent features of the Plan are as follows: The Comission retains responsibility for policy fomulation, rulemaking, and orders and adjudication and may determine whether a matter falls within one of these categories. The Chairman is to initiate personnel actions, subject to Comission approval, for heads of offices reporting directly to the Commission and for the heads of the five major program offices (NRR, NMSS, RES, IE, and SD). The ED0 is to be consulted on actions affecting the program offices. Any Comissioner may initiate personnel actions for positions on the ACRS, subject to Comission approval.
All functions of the Comission not touched on above become the Chairman's alone. He becomes the Commission's official spokesman (0PA and OCA report to him) and the Corm 11ssion's principal executive officer.
In this latter capacity, he shall direct and delegate to the ED0 responsibility for all administrative functions, for the distribution of business, for the preparation of reorganization proposals, budget estimates and allocation of funds and also for personnel matters other than those affecting the heads of offices mentioned above.
Included in the functions reserved to the Chairman is the responsibility to perfom all the functions of the Commission certainina to an emeroency. This may be delegated to another Comissioner or the staff.
The EDO reports for all matters to the Chairman. The Offices of NRR, NMSS, and RES, which formerly reported to the Comission through the EDO, now report to the EDO. The heads of Comission-level offices continue to report directly to the Commission.
The Plan took effect on October 1, 1980.
Actions Taken to Imolement the Reorganization Plan Relevant NRC practices have been or are being modified to implement the Plan:
The Chairman has delegated to the EDO the functions noted above related to the Chairman's role as the principal executive officer of the agency.
In the performance of these functions, the ED0 is governed by Commission decisions authorized by the Plan. The Chairman, or the Commission through the Chairman, makes delegations to the staff. The EDO keeps the Commission fully and currently informed

through the Chairman. All Commissioners have equal access to al,1 cores-spondence between staff and any individual Commissioners.
The Commission has delegated the function of appointing, removing and supervising the staff of Commission-level offices to their respective heads.
The staff has reviewed the delegation of authority of all NRC offices and recommended revisions where appropriate. The staff is reviewing all documents and procedures for possible revision.
The EDO has directed that all Commission papers be prepared for his signature, with any significant staff disagreements summarized in the paper.
The Secretariat has proposed revised procedures for conducting Commission business to comply with the Plan.
