ORDER RELATIVE TO SMUD'S MOTION TO COMPEL TO FRIENDS OF THE EARTH (January 22, 1980)

On December 4, 1979, Sacramento Municipal Utility District (SMUD) issued the " Licensee's First Set of Interrogatories to Friends of the Earth" (FOE), and a request for the production of documents.

It stated that SMUD would eliminate an inde-pendent request since the Staff's interrogatories served on FOE on November 9, 1979, were essentially what SMUD would have served.

Interrogatory 1 adopted the Staff's interrogatories of November 9, 1979, as its own interrogatories.

FOE responded to the Staff's interrogatories on December 7, 1979.

On December 20, 1979, SMUD filed a Motion to Compel since it was not satisfie,d with FOE's response.

FOE did not respond to the Motion to Compel.

_2-On this date, the Board issued a separato order ruling on the Staff's Motion to Compe] and the ruling in that order is adopted by the Board as the ruling on SMUD's Motion to Compel.

The motion is granted.
