ORDER ACCEPTING REFERRAL December 19, 1979 On December 14, 1979 the Licensing Board hearing this case reaffirmed its earlier ruling declining to admit the California Energy Commission's contention on emergency plan-ning and referred that ruling for our consideration. LBP-79-33, 10 NRC __.
We accept the referral as involving a question which should be determined now as a matter of important public interest.

Mr. Moore has been appointed to the Appeal Panel and assigned to this Board effective January 2, 1980; he did not participate in this order.

. The referred issue involves a question of law that was fully briefed before the Licensing Board.
- However, in light of the fuller explanation that the Board gave for its ruling in its order denying reconsideration, we will allow the parties until January 7, 1980 to file supplemental briefs on the merits of the question if they wish to do so.
We will set a time, date and place for oral argument in a later order.
The parties should be familar with and prepared to discuss the relevancy, if any, of the amendments to the emergency planning regulations proposed by the Commis-sion on December 13, 1979.
A copy of that proposal is attached.
