SOUTH TEXAS PROJECT, UNITS 1 AND 2-REQUEST FOR VVITHHOLDING INFORMATION FROM PUBLIC DISCLOSURE (TAC NOS. MF2400, MF2401, MF2402, MF2403, MF2404, MF2405, MF2406, MF2407, MF2408, AND MF2409)

Dear Mr. Koehl:

By letter dated February 13, 2014 (Agencywide Documents Access and Management System (ADAMS) Accession No. ML14052A053), STP Nuclear Operating Company (STPNOC) submitted an affidavit dated February 10, 2014, executed by Ms. Megan A. Stachowiak, Division Manager, Nuclear Services, Alien Science and Technology (Alien), requesting that information designated as proprietary in the documents listed below be withheld from public disclosure pursuant to Title 10 of the Code of Federal Regulations (1 0 CFR), Part 2, Section 2.390.

However, the affidavit did not specifically reference the documents containing the proprietary information. By letter dated May 15, 2014 (ADAMS Accession No. ML14149A353), STPNOC submitted a revised affidavit dated May 13, 2014, making a specific reference to the following documents containing the proprietary information:

STP-specific CASAGrande Input CASA09 JT4 (Proprietary Version)

3.

STP-specific CASAGrande Input CASA22 JT4 (Proprietary Version)

4.

STP-specific CASAGrande Input CASA26 JT4 (Proprietary Version)

5.

STP-specific CASAGrande Input CASA43 JT4 (Proprietary Version)

6.

Proprietary CD (containing copy of electronic files for items 1 through 5]

The proprietary version of the documents are designated as Attachments 2 through 6 and 2 and the revised Alien affidavit is Attachment to the letter dated May 15, 2014, from STPNOC to the U.S. Nuclear Regulatory Commission (NRC), for the STP, Units 1 and 2.

A non-proprietary copy of the documents (Attachments 2 through 6), provided as Attachments 7 through 11 to the letter dated February 13, 2014, has been placed in the NRC's Public Document Room and added to the NRC Library at ADAMS Accession No. ML14052A054. A non-proprietary version of Attachment 12 (Proprietary CD) was not provided since a copy of the non-proprietary version of documents contained by the CD are already provided as Attachments 7 through 11.

The May 13, 2014, affidavit stated that the submitted information should be considered exempt from mandatory public disclosure for the following reasons:

a)

Information that discloses a process, method, or apparatus, including supporting data and analyses, where prevention of its use by Alien's competitors without license from Alion constitutes a competitive economic advantage over other companies.

b)

Information which, if used by a competitor, would reduce his expenditure of resources or improve his competitive position in the design, manufacture, shipment, installation, assurance of quality, or licensing of a similar product.

We have reviewed your application and the material in accordance with the requirements of 10 CFR 2.390 and, on the basis of the statements in the affidavit, have determined that the information sought to be withheld in the submittal, contains proprietary commercial information and should be withheld from public disclosure.

Therefore, the version of the submitted information marked as proprietary will be withheld from public disclosure pursuant to 10 CFR 2.390(b)(5) and Section 1 03(b) of the Atomic Energy Act of 1954, as amended.

Withholding from public inspection shall not affect the right, if any, of persons properly and directly concerned to inspect the documents. If the need arises, we may send copies of this information to our consultants working in this area. We will, of course, ensure that the consultants have signed the appropriate agreements for handling proprietary information.

If the basis for withholding this information from public inspection should change in the future such that the information could then be made available for public inspection, you should promptly notify the NRC. You also should understand that the NRC may have cause to review this determination in the future, for example, if the scope of a Freedom of Information Act request includes your information. In all review situations, if the NRC makes a determination adverse to the above, you will be notified in advance of any public disclosure.
