NOTICE OF AVAILABILITY OF THE DRAFT SUPPLEMENT TO THE FINAL PLANT-SPECIFIC SUPPLEMENT 38 TO THE GENERIC ENVIRONMENTAL IMPACT STATEMENT FOR LICENSE RENEWP.L OF NUCLEAR PLANTS REGARDING INDIAN POINT NUCLEAR GENERATING UNIT NOS. 2 AND 3 (TAC NOS. MD5411 AND MD5412)

Dear Mr. Stilwell:

The U.S. Nuclear Regulatory Commission (NRC) has prepared the enclosed draft supplement to the final plant-specific Supplement 38 to NUREG-1437, "Generic Environmental Impact Statement (GElS) for License Renewal of Nuclear Plants" (GElS), regarding the license renewal of Indian Point Nuclear Generating Unit Nos. 2 and 3 (IP2 and IP3). The proposed action (license renewal) is not a major construction activity.

The NRC staff published its final supplemental environmental impact statement (FSEIS) for IP2 and IP3 in December 2010. Subsequent to publishing the FSE1S, the NRC staff identified new information that necessitated changes to its assessments in the FSEIS. This new information is derived from the following:

  • Entergy Nuclear Operations, Inc. (Entergy), provided comments on the FSEIS that included new information on the entrainment and impingement field data units of measure, and Entergy completed and submitted to the New York State Department of Environmental Conservation a new study that characterizes the IP2 and IP3 thermal plume.

Updated information is also provided in the enclosed draft supplement regarding to NRC's consultations with the National Marine Fistleries Service (NMFS) concerning shortnose and Atlantic Sturgeon at IP2 and IP3.
