NOTICE OF INTENT TO PREPARE A SUPPLEMENT TO SUPPLEMENT 38 TO THE GENERIC ENVIRONMENTAL IMPACT STATEMENT FOR LICENSE RENEWAL OF NUCLEAR PLANTS REGARDING INDIAN POINT NUCLEAR GENERATING UNIT NOS. 2 AND 3 (TAC NOS. MD5411 AND MD5412)

Dear Sir or Madam:

By letter dated April 23, 2007, Entergy Nuclear Operations, Inc. (Entergy), submitted an application to renew the operating licenses for Indian Point Nuclear Generating Unit Nos. 2 and 3 (IP2 and IP3) for an additional 20 years. In support of the application and in accordance with Title 10 of the Code of Federal Regulations (10 CFR) Part 51 and 10 CFR Part 54, Entergy also submitted an environmental report for IP2 and IP3. In December 2010, the U.S. Nuclear Regulatory Commission (NRC) staff issued the final plant-specific Supplement 38 to NUREG-1437, Generic Environmental Impact Statement for License Renewal of Nuclear Plants (GEIS) (FSEIS), regarding the renewal of the IP2 and IP3 operating licenses DPR-26 and DPR-64 for an additional 20 years of operation. In June 2013, the NRC staff issued a supplement to the FSEIS to incorporate new and revised information related to the impacts from IP2 and IP3 on aquatic species.

Pursuant to 10 CFR 51.92(c), if a proposed action has not been taken, the NRC staff may prepare a supplement to a final environmental impact statement when, in its opinion, preparation of a supplement will further the purposes of the National Environmental Policy Act (NEPA).

Subsequent to the issuance of the 2013 supplement to the FSEIS, the NRC staff has identified information relevant to the environmental review of the IP2 and IP3 license renewal application and has determined that documenting an assessment of this information in a supplement to the FSEIS would assist decision makers and further the purposes of NEPA. Therefore, the NRC has prepared a Notice of Intent advising the public that the NRC intends to prepare a second supplement to the FSEIS to address information relevant to environmental impacts of license renewal, including new aquatic impact data, refined cost estimates associated with the severe accident mitigation alternatives analysis, and other matters. Enclosed is a copy of the Notice of Intent, which has been forwarded to the Office of the Federal Register for publication.
