MEMORANDUM (Regarding the Status of the CRORIP Petition To Intervene and Section 2.335 Petition)

On December 10, 2007, the Board received, via electronic mail, a copy of a Petition To Intervene and Request For Hearing, and a Section 2.335 Petition that were submitted on behalf of Connecticut Residents Opposed to Relicensing of Indian Point (CRORIP) by Ms. Nancy Burton, the representative for CRORIP.

However, the Board notes that in Dominion Nuclear Connecticut, Inc. (Millstone Nuclear Power Station, Units 1 and 2), CLI-06-4, 63 NRC 32, (2006), the Commission directed the Office of the Secretary to screen all filings bearing Ms. Burtons signature and not to accept or docket them unless they meet all procedural requirements [and] to reject summarily any non-conforming pleadings without referring them to the Atomic Safety and Licensing Board Panel or the Commission. Id. at 37.

Accordingly, the Board will not take any action with regard to the Petition To Intervene and Request For Hearing, or the Section 2.335 Petition, that were submitted on behalf of CRORIP by Ms. Nancy Burton unless and until we have been advised by the Office of the Secretary that these pleadings have been accepted for filing or docketing.
