TECHNICAL SPECIFICATION TASK FORCE (TSTF) TRAVELER 400-A, REVISION 1, CLARIFY SR ON BYPASS OF DG AUTOMATIC TRIPS

Dear TSTF Members:

By letter dated July 20, 2009,1 the U.S. Nuclear Regulatory Commission (NRC) requested a meeting to discuss TSTF Traveler 400-A, Revision 1, Clarify SR [surveillance requirement] on Bypass of DG [diesel generator] Automatic Trips.2 Traveler 400-A, Revision 1, removes the list of emergency diesel generator (EDG) critical trips from Improved Standard Technical Specifications (TS) Surveillance Requirement (SR) 3.8.1.13. Mr. Brian Mann, Vice President of Industry Programs, EXCEL Services Corporation, responded with comments via e-mail dated July 21, 2009.3 The comments regarding Regulatory Guide 1.9, Revision 4, and the SR modifications, will be discussed during a public meeting scheduled for August 11, 2009. The NRC staff recognizes the validity of Mr. Manns comments regarding TS Bases Control Programs. The NRC staffs letter characterized one concern as related to TS Bases Control Program, this issue actually relates to proper relocation of information from the TS. The following clarification to the July 20, 2009, letter is made to more accurately describe this concern:

NRC practice as exemplified in Generic Letter 95-10, Relocation of Selected Technical Specifications Requirements Related to Instrumentation, December 15, 1995, has been to accept relocation of information from the TS to the Updated Final Safety Analysis Report (UFSAR).4 This practice ensures that the relocated information will be subject to evaluation under Title 10 of the Code of Federal Regulations (10 CFR) Section 50.59 since it resides, or is incorporated by reference, in the UFSAR.

In the case of Traveler 400-A, Revision 1, information being relocated from the TS should be placed in the UFSAR, or another licensee controlled document incorporated by reference in the UFSAR. This will ensure that changes to the information will be subject to evaluation under the criteria contained in 10 CFR 50.59(c)(2). The TS Bases Control Program requires the licensee to apply the criteria of 10 CFR 50.59 to changes made to the TS Bases. Relocation of TS information to the UFSAR ensures that changes to the TS Bases will not be inadvertently screened out from evaluation because the information is not described in the UFSAR. Unless the licensees UFSAR explicitly incorporates the TS Bases by reference, relocating this information to the TS Bases alone does not provide the level of control required to ensure that prior NRC approval is required for changes to the information.
