Dear Mr. Blanch:
I am writing in response to your letter dated July 3, 2007, requesting clarification of a statement I made during a public meeting on June 27, 2007, concerning the NRCs license renewal process as it applies to Indian Point. You state, in your letter, in response to my questions I believe you stated that the NRC would assure that Indian Point is and will remain in compliance with all parts of 10 CFR. You also request that I provide you with a listing of those regulations contained within 10 CFR that are applicable to the design, construction and operation of the three reactors located on the Indian Point site with specific emphasis on the requirements of 10 CFR 20, 50 and 100 and all appendices.
For clarification, in answering your question at the meeting, my intent was to explain that Indian Point is governed by the regulations in 10 CFR Part 50, as well as other applicable parts of the regulations, such as the provisions in 10 CFR Part 73. As you may know, an operating nuclear power plant is subject to various requirements in 10 CFR Part 50 as well as the provisions of numerous other regulations. The Indian Point facility is and will be required to remain in compliance with all applicable requirements of 10 CFR Part 50 and other applicable regulations (except as exempted) during its current operating term as well as the period of extended operation, if a renewed license is issued.
Regarding your request for a listing of regulations applicable to the design, construction and operation of the three reactors located on the Indian Point site, such information can be found in a variety of documents, including but not limited to orders, license conditions, exemptions, technical specifications, licensing correspondence, and the most recently updated final safety analysis report for a specific facility. In general, you can also find the principal parts of the NRC regulations applicable to each specific type of license on our NRC website at http://www.nrc.gov/about-nrc/regulatory/rulemaking/access-regs.html.
Publicly available documents and correspondence related to Indian Point Nuclear Generating Unit Nos. 1, 2, and 3 are placed in the NRC's Public Document Room (PDR) in Rockville, Maryland, and can be accessed through the Electronic Reading Room. Members of the public may access the Electronic Reading Room libraries from computers with Internet access by going to http://www.nrc.gov/reading-rm/pdr.html.
