Dear Mr. Price:

The NRC Office of Investigations (OI), Region I Field Office, initiated an investigation (Case No.

1-2002-019) to determine if two security guards employed by Burns International Security Services, working at Millstone were discriminated against for engaging in protected activities.

Based on the evidence developed during this investigation, OI did not substantiate that the disciplinary actions taken against the two security guards were for engaging in protected activity. A copy of the synopsis of OI Report 1-2002-019 is enclosed for your information.

Please note that final NRC documents, such as the OI report described above, may be made available to the public under the Freedom of Information Act (FOIA) subject to redaction of information appropriate under the FOIA. Requests under the FOIA should be made in accordance with 10 CFR 9.23, Requests for Records, a copy of which is enclosed for your information.

Also, in accordance with 10 CFR 2.790 of the NRCs "Rules of Practice," a copy of this letter, its enclosure, and your response, if any, will be available electronically for public inspection in the NRC Public Document Room or from the Publicly Available Records (PARS) component of NRCs document system (ADAMS). ENCLOSURE 1 RI-2002-A-0057 RI-2002-A-0059 This investigation was initiated by the U. S. Nuclear Regulatory Commission, Office of Investigations (OI), Region I, on May 2, 2002, to determine if two contractor security guards employed by Burns International Security Services, Utilities Nuclear Security Division, working at Dominion Nuclear Connecticuts (Dominion) Millstone Power Station were discriminated against for engaging in protected activities. Specifically, the first security guard believed he/she was forced to resign in January 2002; the second security guard believed that he/she was unjustly accused of damaging Dominion equipment and suspended without pay from February to November 2002, for raising safety concerns that involved security issues at Millstone and for complaining to Millstones Employee Concerns Program.

Based on the evidence developed during this investigation, OI did not substantiate that either security guard was discriminated against as a result of having engaged in protected activities.
