MILLSTONE POWER STATION, UNIT NO. 3 - EXEMPTION FROM THE REQUIREMENTS OF 10 CFR 50.46, AND APPENDIX K TO 10 CFR PART 50 REGARDING USE OF M5 CLADDING MATERIAL (EPID L-2023-LLE-0013)
Dear Eric Carr:
The U.S. Nuclear Regulatory Commission has approved the enclosed exemption from the specific requirements of Title 10 of the Code of Federal Regulations (10 CFR) Section 50.46, Acceptance criteria for emergency core cooling systems for light-water nuclear power reactors, and 10 CFR Part 50, Appendix K, ECCS [Emergency Core Cooling System] Evaluation Models, for the Millstone Power Station, Unit No. 3 (Millstone 3). This action is in response to your application dated May 2, 2023, as supplemented by letter dated April 1, 2024, that requested an exemption from the above regulations to use Framatome GAIA fuel assemblies containing fuel rods fabricated with M5TM cladding material at Millstone 3.
A copy of the exemption is enclosed. The exemption has been forwarded to the Office of the Federal Register for publication.
