FOLLOW-UP REPORT 05000336/2024440 AND 05000423/2024440 AND

PRELIMINARY FINDING (S) OF GREATER THAN VERY LOW SIGNIFICANCE

AND NRC INVESTIGATION REPORT NO. 1-2024-001

Dear Eric Carr:

On April 11, 2024, the U.S. Nuclear Regulatory Commission (NRC) completed an in-office

follow-up inspection associated with a Special Inspection that occurred at Millstone Power

Station, Units 2 and 3, that was documented in NRC Inspection Reports 05000336/2023440

and 05000423/2023440 (ML24010A177 (non-public) and ML24010A182 (public)). The results of

the follow-up inspection were discussed with Michael OConner, Site Vice President, and other

members of your staff on April 11, 2024.

The special inspection reviewed the circumstances surrounding an event that occurred on

November 8, 2023, and examined activities conducted under your licenses as they relate to

safety, security, and compliance with the Commissions rules and regulations, and with the

conditions of your licenses. The special inspection report concluded that there was one issue of

concern which warranted additional review to determine the nature and characterization of any

associated regulatory deficiencies.

The enclosed report documents one or more findings that the NRC has preliminarily determined

to have greater than very low security significance. In accordance with the NRC Enforcement

Manual, the NRC does not discuss the number of security-related findings that are potentially

characterized as greater than very low significance. We assessed the significance of the

finding(s) using the Baseline Security Significance Determination Process for Power Reactors,

and readily available information. The finding(s) and basis for the NRCs preliminary significance

determination are described in the enclosed non-public report (Enclosure 1).

The following cross-cutting aspect was assigned to a finding(s) using Inspection Manual

Chapter (IMC) 0310, Aspects Within Cross Cutting Areas: [H.2] - Field Presence.

In accordance with NRC IMC 0609, we intend to complete our evaluation using the best

available information and issue our final determination of safety significance within 90 days of

the date of this letter. The significance determination process (SDP) encourages an open

dialogue between the NRC staff and the licensee; however, the dialogue should not impact the

timeliness of the staffs final determination.

In addition to the inspection, an investigation of the November 8, 2023, event was initiated on

November 14, 2023, by the NRC Office of Investigations (OI) and completed on December 21,

2023. Because the investigation involved security matters that are considered sensitive

information, the details of the investigation are not included in this letter. Based on the evidence

gathered during the investigation, the NRC identified one or more apparent violations (AV(s))

that are being considered for escalated enforcement action in accordance with the NRC

Enforcement Policy. The current Enforcement Policy is available on the NRCs Web site at

http://www.nrc.gov/about-nrc/regulatory/enforcement/enforce-pol.html. A factual summary of OI

Investigation Report No. 1-2024-001 is included in the non-public Enclosure 2 to this letter. The

description of the AV(s) is included in the non-public Enclosure 1 of this letter.

Because we have not made a final determination, no notice of violation is being issued at this

time. Please be aware that further NRC review may prompt us to modify the number and

characterization of the AV(s). In addition, since your site has not been the subject of escalated

enforcement actions within the last 2 years, and based on our understanding of your corrective

action, a civil penalty may not be warranted in accordance with Section 2.3.4 of the

Enforcement Policy.

Before we make a final decision, you may choose to communicate your position both on the

facts and assumptions used to arrive at the finding(s) and the AV(s), its/their significance,

cross-cutting aspect(s), and to reach a final enforcement decision by either (1) attending and

presenting at a combined regulatory conference/pre-decisional enforcement conference or (2)

submitting your position in writing. You may also choose to accept the finding(s) and the AV(s).

The focus of a combined regulatory conference/pre-decisional enforcement conference is to

discuss the significance of the finding(s), identification of the AV(s), and your corrective actions.

If you choose to respond in writing please mark your response Pre-decisional Reply to EA-23-

144 and send to U.S. Nuclear Regulatory Commission, ATTN: Document Control Center,

Washington, DC 20555-0001 with a copy to the Regional Administrator, Region I; the Director,

Office of Enforcement; the Director, Office of Nuclear Security and Incident Response; and a

copy to Daniel Schroeder, Chief, Security, Emergency Preparedness and Incident Response

Branch, U.S. Nuclear Regulatory Commission, Region I, 475 Allendale Road, Suite 102, King of

Prussia, PA 19406-1415 within 30 days of the date of this letter. Responses related to the AV(s)

should include: (1) the reason for the AV(s) or, if contested, the basis for disputing the AV(s); (2)

the corrective steps that have been taken and the results achieved; (3) the corrective steps that

will be taken; and (4) the date when full compliance will be achieved. Your response may

reference or include previously docketed correspondence if the correspondence adequately

addresses the required response.

If you request a combined regulatory conference/pre-decisional enforcement conference, it

should be held within 40 days of your receipt of this letter. Please provide information you would

like us to consider or discuss with you at least 10 days prior to any scheduled conference. If you

choose to attend a combined regulatory conference/pre-decisional enforcement conference, it

will be closed for public observation because the NRCs preliminary finding(s) involve security-

related matters and are based on an NRC OI report that has not been publicly disclosed.

Please contact Daniel Schroeder at 610-337-5262, and in writing, within 10 days from the

issue date of this letter to notify the NRC of your intentions. If we have not heard from you

within 10 days, we will continue with our significance determination and enforcement decision.

This letter will be made available for public inspection and copying at

http://www.nrc.gov/reading-rm/adams.html and at the NRC Public Document Room in

accordance with Title 10 of the Code of Federal Regulations (10 CFR) 2.390, Public

Inspections, Exemptions, Requests for Withholding.

The enclosed report contains Security-Related Information, so the enclosed report will not be

made publicly available in accordance with 10 CFR 2.390(d)(1). If you choose to provide a

response that contains Security-Related Information, please mark your entire response

Security-Related Information-Withhold from public disclosure under 10 CFR 2.390 in

accordance with 10 CFR 2.390(d)(1) and follow the instructions for withholding in

10 CFR 2.390(b)(1). If Safeguards Information is necessary to provide an acceptable response,

please provide the level of protection described in 10 CFR 73.21. The NRC is waiving the

affidavit requirements for your response in accordance with 10 CFR 2.390(b)(1)(ii).
