Dear Sir:

The New York Power Authority (Authority) hereby transmits an application for amendment to James A. FitzPatrick Nuclear Power Plant Facility Operating License No.

DPR-59. Also enclosed are the proposed changes including a marked up version to the / i Radiological Effluent Technical Specifications (RETS) set forth in Appendix B of the /

operating license. Supporting information and analyses demonstrating that the proposed changes involve no significant hazards consideration pursuant to 10 CFR 50.92 are included as Attachment II. These changes resulted from corrective actions associated with License Event Report LER-98-001 (Reference 1).

The proposed RETS changes represent revisions to RETS Section 3.5.b.1, " Main Condenser Steam Jet Air Ejector (SJAE)" and Table 3.10-1 " Radiation Monitoring Systems that Initiate and/or Isolate Systems" including associated Bases. The existing RETS for radiation monitoring instrumentation systems that initiate and/or isolate systems will be improved by adding Allowable Outage Times (AOTs) and incorporating editorial and administrative changes to clarify requirements.

The AOTs included in this amendment request are consistent with the improved Standard Technical Specifications (Reference 2).

The signed original of the Application for Amendment to the Operating License is enclosed for filing. Attachment I contains the proposed new Technical Specification (TS) pages. Attachment ll contains a description of the changes and the Safety Evaluation for the proposed changes. Attachment 111 contains a mark-up of the affected TS pages.
