All fuel facility and materials licensees.
Purpose
This information notice supplement is being provided to present new information
on licensing and fee requirements for processing financial assurance submittals
for decommissioning as discussed in U.S. Nuclear Regulatory Commission (NRC)
Information Notice 90-38. It is expected that licensees will.review this
information for applicability to their licensed activities. The information in
this notice does not constitute any new NRC requirements, and no written response
is required.
Discussion:
Information Notice 90-38 was issued on May 29, 1990, and informed fuel facility
and materials licensees of the licensing and fee requirements for processing
financial assurance submittals for decommissioning. Upon further evaluation of
the intent of the NRC rule entitled, *General Requirements for Decommissioning
Nuclear FacilitiesO (53FR24018, 06/27/88). NRC has determined.that financial
assurance submittals required to be submitted to NRC by July 27, 1990, will not
be processed as license amendments and are not subject to license fees under
10 CFR Part 170.
Requests to change or restrict authorized possession limits for byproduct, source, or special nuclear material, or to delete radionuclides in response to
financial assurance requirements, will be processed as license amendments and
will be subject to the amendment fee for the appropriate fee category assigned
to the license. In addition, requests for exemption from the financial
assurance regulations will be processed as license amendments and will be
subject to amendment fees. However, fees will not be charged for amendments to
routine nuclear medicine, sealed source, and radiography licenses, to establish
a total possession limit, when such licenses were written without a total
