In accordance with our letter of December 8, 1986, we are responding to your reply to Violation 482/8619-03 contained in your letter of October 22, 1986.
We have performed the backfit determination that you requested and concluded that the NRC position on reportability has not changed and the reporting requirement identified in Violation 482/8619-03 is not a backfit.
Neverthe-less, we believe inspector actions may have contributed to confusion regarding the acceptance of your classification of the event and the associated reporting requirements and, therefore, we are withdrawing Violation 482/8619-03.
A detailed respnnse to your reply is contained in the attachment to this letter. The material enclosed herewith contains Safeguards Information as identified by 10 CFR 73.21 and its disclosure to unauthorized individuals is prohibited by Section 147 of the Atomic Energy Act of 1954, as amended.
Therefore, the material will not be placed in the Public Document Room Should you disagree with our determination of this matter, KG&E has the right to appeal this decision in accordance with 10 CFR 50.109 and Manual Chapter 0514, Section 0514-044 Please contact Mr. Larry Yandell at 817/860-8108 if you have any questions regarding this matter.

Dear Mr. Johnson:
This letter is written in response to your letter of Septecber 26, 1986, which transmitted Inspection Report STN 50-482/86-19.
As requested, the violations (482/8619-01, 02, and 03) identified in the Inspection Report are being addressed in four parts, i
(a) The reason for the violations if admitted; i

(b) The corrective steps which have been taken and the results

achieved; i
(c) Corrective steps which will be taken to avoid further violations; and

(d) The date when full compliance will be achieved.

Kansas Gas and Electric Company (KG&E) believes that violation 8619-03 o
resulted from a change in interpretation of 10 CFR 73.71(c) by the KRC b
Region IV inspectors.
In accordance with 10 CFR 50.109 "Backfitting" and NRC Manual Chapter 0514 "NRC Program for Management of Plant-Specific Backfitting of Nuclear Power Plants",
KG&E requests that NRC Region IV
,
perform a backfit determination on this change.
Supporting rationale for this request is included in the attached response to the violation.
KG&E j
believes this request is consistent with Mr. Stello's March 3, 1986, letter
,
to Mr. Wilson Cadman which encouraged utilities to become familiar with the l
backfit process and to identify potential backfit items.

Attachment A contains Safeguards Information in accordance with 10 CFR 73.21 and therefore should be withheld from public disclosure. This letter, when seperated from the attachment does not contain Safeguards Information and should be handled as decontrolled.
