FINAL DETERMINATION OF A PRELIMINARY SECURITY-RELATED GREATER-THAN-GREEN FINDING; BEAVER VALLEY POWER STATION, UNITS 1 AND 2, INSPECTION REPORT NO. 05000334/2013201 AND 05000412/2013201

Dear Mr. Larson:

This letter provides you with the final determination for a finding preliminary determined to be of at least low to moderate security significance (greater-than-green). The finding was identified in our previous communication dated August 8, 2013, which included the subject inspection report.

This greater-than-green finding was discussed in detail in Section 3.6 of the subject inspection report.

At your request, a regulatory conference was held on September 5, 2013, to further discuss your views on this issue. During the meeting, your staff described your assessment of the significance of the finding, the corrective actions taken to resolve it, and included a root cause analysis. After considering the additional information that you provided at the regulatory conference, the U.S. Nuclear Regulatory Commission (NRC) has determined that a finding did not occur. However, the NRC will be conducting additional inspection activities to evaluate your corrective actions to address the performance aspects in this area.

In accordance with Title 10 of the Code of Federal Regulations (10 CFR) 2.390 of the NRC's

"Rules of Practice," a copy of this letter will be available electronically for public inspection in the NRC Public Documents Room or from the Publicly Available Records component of NRC's Agencywide Documents Access and Management System (ADAMS). ADAMS is accessible from the NRC Web site at http://www.nrc.gov/reading-rm/adams.html (the Public Electronic Reading Room).

However, the material enclosed herewith contains security-related information in accordance with 10 CFR 2.390(d)(1) and its disclosure to unauthorized individuals could present a security vulnerability. Therefore, the material in the enclosure will not be made available electronically for public inspection in the NRC Public Document Room or from the NRCs document system ADAMS.

The enclosure transmitted herewith contains Official Use Only - Security-Related Information.

When separated from the enclosure, this transmittal document is decontrolled. If security-related information is necessary to provide an acceptable response, please mark your entire response Security-Related Information in accordance with 10 CFR 2.390(d)(1) and follow the instructions for withholding in 10 CFR 2.390(b)(1). In accordance with 10 CFR 2.390(b)(1)(ii), the NRC is waiving the affidavit requirements for your response.
