INDIAN POINT ENERGY CENTER: NRC SECURITY INSPECTION REPORT 05000247/2013404 AND 05000286/2013404
Dear Mr. Ventosa:
On December 12, 2013, the U.S. Nuclear Regulatory Commission (NRC) completed a security inspection at your Indian Point Energy Center (IPEC), Units 2 and 3. The inspection covered one or more of the key attributes of the security cornerstone of the NRCs Reactor Oversight Process. The enclosed inspection report documents the inspection results, which were discussed on December 12, 2013, with Mr. Walpole, Manager, Regulatory Affairs and other members of your staff.
The inspection examined activities conducted under your licenses as they relate to safety and compliance with the Commissions rules and regulations and with the conditions of your licenses. The inspectors reviewed selected procedures and records, observed activities, and interviewed personnel.
Three NRC identified findings and one self-revealing finding of very low security significance (i.e., Green as determined by the Baseline Security Significance Determination Process) were identified during this inspection. The deficiencies were promptly corrected or compensated for, and the plant was in compliance with applicable physical protection and security requirements within the scope of this inspection before the inspectors left the area.
All of these findings were determined to involve violations of NRC requirements. The NRC is treating these violations as non-cited violations (NCV) consistent with Section 2.3.2 of the NRC Enforcement Policy. If you contest any NCV in the enclosed report, you should provide a response within 30 days of the date of this inspection report, with the basis for your denial, to the Nuclear Regulatory Commission, ATTN: Document Control Desk, Washington, DC 20555-0001; with copies to the Regional Administrator, Region I; the Director, Office of Enforcement, United States Nuclear Regulatory Commission, Washington, DC 20555-0001; and the NRC Resident Inspector at Indian Point Energy Center.
Enclosure contains Sensitive Unclassified Non-Safeguards Information. When separated from enclosure, the transmittal document is decontrolled. Two cross-cutting aspects were assigned to the findings in the area of Human Performance and one cross-cutting aspect was assigned in the area of Problem Identification and Resolution.
Two cross-cutting aspects were assigned in the area of Human Performance because the licensee failed to provide training of personnel and sufficient qualified personnel, to maintain work hours within working hours guidelines H.2(b) and did not ensure supervisory and management oversight of work activities such that nuclear security was supported H.4(c). One cross-cutting aspect was assigned in the area of Problem Identification and Resolution because the licensee failed to implement a corrective action program with a low threshold for identifying issues completely, accurately, and in a timely manner commensurate with their security significance [P.1 (a)]. If you disagree with a cross-cutting aspect assignment in this report, you should provide a response within 30 days of the date of this inspection report, with the basis for your disagreement, to the Regional Administrator, Region I; and the NRC Resident Inspectors at the Indian Point Energy Center, Units 2 and 3.
