| Title | Failure to Follow Operability Procedure |
| Description | The team identified a non-cited violation of 10 CFR Part 50, Appendix B, Criterion V, Instructions, Procedures, and Drawings, associated with the licensees failure to follow Station Procedure NOD-QP-31, Operability Determination Process. Specifically, Step 4.3.15 required, in part, that, A positive determination of operability must be justified, including ... a technical discussion of why the concern identified does not prevent the item from fulfilling its intended safety function. The team identified that the operability determination associated with a component identified as beyond its specified service life lacked adequate technical justification for why the item was operable with the degraded or nonconforming condition. The licensee addressed this issue by establishing an adequate basis for operability for the non-conformances. The licensee entered this deficiency into their corrective action program for resolution as CR 2013-12255. The failure to properly assess and document the basis for operability when a degraded or nonconforming condition was identified is a performance deficiency. This performance deficiency was more than minor, and therefore a finding, because it is associated with the equipment performance attribute of the Mitigating Systems Cornerstone and affected the cornerstone objective to ensure the availability, reliability, and capability of systems that respond to initiating events to prevent undesirable consequences. Since the finding involving inadequate operability determinations occurred while in a shutdown condition, the team used Manual Chapter 0609, Appendix G, Shutdown Operations Significance Determination Process, and determined the finding to have very low safety significance (Green) because the finding: (1) did not increase the likelihood of a loss of reactor coolant system inventory; (2) did not degrade the licensees ability to terminate a leak path or add reactor coolant system inventory when needed; and (3) did not degrade the licensees ability to recover decay heat removal once it was lost. This finding has a cross-cutting aspect in the area of human performance, associated with the decision-making component, because the licensee failed to use conservative assumptions in decision making when performing operability determinations. |
