FORT CALHOUN STATION - NRC INSPECTION REPORT 05000285/2014407; NRC INVESTIGATION REPORT NO. 4-2013-017; AND NOTICE OF VIOLATION
Dear Mr. Cortopassi:
This letter refers to an investigation completed by the U.S. Nuclear Regulatory Commission (NRC), Office of Investigations, Region IV, on December 13, 2013, to determine, in part, if an employee at the Fort Calhoun Station willfully failed to perform required duties. NRC inspectors discussed the results of this inspection with you and other members of your staff during a telephonic exit briefing on April 29, 2014. A summary of this investigation is included as Enclosure 1.
Based on the results of this investigation, the NRC has determined that a Severity Level IV violation of NRC requirements occurred. The NRC evaluated this violation in accordance with the NRC Enforcement Policy. The current Enforcement Policy is included on the NRCs Web site at www.nrc.gov/about-nrc/regulatory/enforcement/enforce-pol.html. The violation is cited in the enclosed Notice of Violation (Notice) and the circumstances surrounding it are described in the investigation summary. The violation is being cited because it involves an individuals willful failure to comply with regulatory requirements at Fort Calhoun Station.
You are required to respond to this letter and should follow the instructions specified in the enclosed Notice when preparing your response. If you have additional information that you believe the NRC should consider, you may provide it in your response to the Notice. The NRC will use your response, in part, to determine whether further enforcement action is necessary to ensure compliance with regulatory requirements. In accordance with Title 10 of the Code of Federal Regulations (10 CFR) 2.390, Public Inspections, Exemptions, Requests for Withholding, of the NRCs Rules of Practice and Procedure, a copy of this letter will be available electronically for public inspection in the NRC Public Document Room and in the NRCs Agencywide Documents Access and Management System (ADAMS). ADAMS is accessible from the NRC Web site at http://www.nrc.gov/reading-rm/adams.html.
However, the material enclosed herewith contains Security-Related Information in accordance with 10 CFR 2.390(d)(1) and its disclosure to unauthorized individuals could present a security vulnerability.
