LICENSEE'S RESPONSE TO STAFF'S MOTION TO CONFORM PROPOSED TECHNICAL SPECIFICATIONS IN ACCORDANCE WITH JULY 8, 1985 AMENDMENT OF ORDER By Order of the Director, Office of Nuclear Reactor Regu-lation, dated February 11, 1980, the Commission established a set of formal license requirements reflecting the post-accident condition of the TMI-2 facility and assuring the continued maintenance of the current safe, stable, long-term cooling con-

- dition of the facility. The February 11 Order further provided that the requirements of the proposed Technical Specifications (attached to the Order) were immediately effective, with an op-portunity for hearing prior to the effectiveness of the pro-posed formal license amendment. At the time the February 11 Order was issued, both the Staff and Licensee anticipated that, *

6 On July 8, 1985, the Director of the NRC Office of Nuclear Reactor Regulation-issued an " Amendment of Order," to add cer-tain exceptions to the valve isolation requirements of the pro-posed Technical Specifications. These matters are reflected in modifications to Section 1.7 of the proposed Technical Specifi-4 cations and a new Table 3.6-2 which lists exceptions to con-tainment penetration valve configurations.

By the July 23, 1985 "NRC Staff Notice of Issuance of Amendment of Order and Motion To Conform Proposed Technical Specifications In Accordance Therewith," the Staff has moved that the proposed Technical Specifications attached to the February 11, 1980 Order be formally modified in accordance with the July 8, 1985 " Amendment of Order," subject to the authority which 10 C.F.R. S 2.717(b) reserves to the presiding officer in l this proceeding. The Staff's motion notes that the new Table i

3.6-2 attached to the July 8, 1985 " Amendment of Order" in-cludes two typographical errors.1/ The Staff indicates that a correction to the " Amendment of Order" is being issued, and will be forwarded promptly to the Board.

As Licensee understands the Staff's motion, it is simply a request by the Staff that the Board issue an order notifying all parties that the proposed Technical Specifica'tions under consideration in the prospective hearing requested in this 1/ In the copy of Table 3.6-2 attached to the July 8, 1985

" Amendment of Order," the penetrations designated R-537 and R-577 should be designated R-573 and R-557 respective-ly.
