In a Federal Register Notice (Schedule of 11 earings) served on the parties on 9-28-88),

it was stated,  !

Written Ifalited appearance statements may by filed with the Board prior to October 28,1988. After review of the mitten statarents,the Board will decide whether to schedule oral limited appearance statements.

I Joint Intervenors(JI) are hereby filing a motion for the Judget to reconsider this part of the Order wherein the public is given a deadline for filing testimony and the Judges are reserving the right to decide whether or not to schedule limited appearance statanents.

'Ihe reasors for this mot ton are as follows. In an Order, dated 11.3.87(Scheduling Specini Prehearing Conference) it was stated, The public is invited to attend the prehearing conference but nunbers of the public may not participate in this conference.

7 An opportunity will be provided for any person who wishes to make an oral statment in this proceeding but who has not filed a petition for leave to intervene. Any person may request pennission to make a limited appearance in order to set forth his position on the issues pursuant to provisions of 10 C.F.R 2.715 of the Cannission's "Rules of Practice".

To date,the public have not made statments before this panel on this matter.

JI therefore request:

. 1) We public retain that right given in the Order of 11.3.87 to make limited appearance stamments before this panel.

2) A special evening s@ ion is held to acemmodate tfc public and at which they may make their statements.
3) %e public may make a statment about this matter at the special session without having to request prior permission. 'Ihis request is in light of the fact that those doctments,wherein the Order is stated,are most likely not widely read doctments,and therefore the public may be unaware of the right to speak on this matter. Also, the public would not therefore have to file thair statement prior to the session. It is JI's understanding that previous sessions concerning 'IMI, Unit 2 were granted so that the public could attend the session and speak without prior notice.
4) 'Ihe public is given notice of their right to speak at a special session on this matter by advertisment in newspapers,'IV and radio.
