SVA/TMIA's Motion to Subnit Witness's Testimony as Evidence Without Cross-Examination.

,at: Hearings in Lancaster On tenday October 3rd., Joint Intervenors(JI) confinmd that for personal reasons Dr C.W.lbver would ret be abic to attend the Hearings in Lancaster for cross-examination. Dr Ibver had previously subnitted an affadavit in support of JI's response to the Licensee's request for Sumury Disposition. Dr Huver will subnit testimony in these proceedings for SVA/TNIA.

JI request that Dr ibver's testinony is accepted as evidence in these proceedings without the need for cross exanination. According to Dr Ibver this has been done before in the Hearings of Davis Besse, Midland and Limerick (perhaps in the 1970s)

In the alternative,JI request that the record is left open so that cross examination can take place in Minnesota. Dr C.W lbver has agreed to be cross-exanined in Forest Lake, Minnesota. In this alternative,Dr ibver's testinony could be entered into these proceedings by way of deposition. JI also request that the costs of transcribing the deposition would be borne by that agency which pays those samd costs if Dr Ibver had cane to 1.ancaster for cross-exanination.

' In the alternative,JI request that the Hearing is noved to Minnesota for that time required to cross-exanine Dr ibver. ,4 The subject uutter of Dr Ibver's testinony is emeial to JI's , presentation of evidence in this proceeding. JI are therefore respectfully subnitting this Motion.
