DOCKETS 50-266 AND 50-301 RESPONSE TO NOTICE OF VIOLATION INSPECTION REPORT 50-266/93017(DRSS) AND 50-301/93017(DRSS) '

POINT BEACH NUCLEAR PLANT. UNITS 1 AND 2 In a letter from Ms. C. D. Pederson, dated December 17, 1993, the Nuclear Regulatory Commission forwarded to Wisconsin Electric Power Company (WE) , licensee for the Point Beach Nuclear Plant, the results of a physical security inspection performed by Mr. T. J. Madeda. The inspection was conducted from November 15  ;

through 18, 1993, The inspection reports, 50-266/93017(DRSS) and 50-301/ 93 017 (DRSS) , included a Notice of Violation (NOV).

The NOV describes a violation of Section 3.F of Amendments 37 and 42 of Facility Operating Licenses No._DPR-24 and No. DPR-27.

Section 3.F requires WE to maintain in effect and fully implement all provisions of the NRC approved Physical Security and Contingency Plans, including amendments and changes made pursuant to the authority of 10 CFR 50.54(p).

Section 3.1 of the approved PBNP Security Plan requires that individuals who have not been authorized unescorted access, shall be continuously escorted, i.e. observed, while within the protected area. This NOV states, " Contrary to the above, on November 17, 1993, an NRC inspector observed two visitors who were not continuously escorted, i.e. observed, while_within the protected area".

i We have reviewed this NOV and, pursuant to the provisions of 10 CFR 2.201, have prepared a written response of explanation  ;

concerning the identified violation. Our written response is
