Dear Dr. Hayden:

l Thank you for your letter of December 3,1996,in response to our letter and Notice of Violation dated November 8,1996. We have reviewed your reply and note that supplementalinformation has been provided in regard to Violation B, which was not provided to the inspector during the inspection. In the Notice, we identified your failure to perform annual reviews of the content and the implementation of the radiation protection l program associated with the AGN-201M reactor. In your reply, you contested the violation and provided copies of the university's radiation protection program reviews performed i during December 1994 and December 1995 by the university's office of radiological safety. Based on the review of this information, we have decided to rescind Violation B. !

With regard to Violations A and C, we find your reply responsive to the concerns raised in our Notice of Violation.

We will review the implementation of your corrective actions during a future inspection to determine that full compliance has been achieved and will be maintained.
