CAW-94-584(a)Theinformationrevealsthedistinguishingaspectsofaprocess(orcomponent,structure,tool,method,etc.)wherepreventionofitsusebyanyofWestinghouse'scompetitorswithoutlicensefromWestinghouseconstitutesacompetitiveeconomicadvantageoverothercompanies.(b)Itconsistsofsupportingdata,includingtestdata,relativetoaprocess(orcomponent,structure,tool,method,etc.),theapplicationofwhichdatasecuresacompetitiveeconomicadvantage,e.g.,byoptimizationorimprovedmarketability.(c)Itsusebyacompetitorwouldreducehisexpenditureofresourcesorimprovehiscompetitivepositioninthedesign,manufacture,shipment,installation,assuranceofquality,orlicensingasimilarproduct.(d)Itrevealscostorpriceinformation,productioncapacities,budgetlevels,orcommercialstrategiesofWestinghouse,itscustomersorsuppliers.(e)Itrevealsaspectsofpast,present,orfutureWestinghouseorcustomerfundeddevelopmentplansandprogramsofpotentialcommercialvaluetoWestinghouse.(f)Itcontainspatentableideas,forwhichpatentprotectionmaybedesirable.TherearesoundpolicyreasonsbehindtheWestinghousesystemwhichincludethefollowing:(a)TheuseofsuchinformationbyWestinghousegivesWestinghouseacompetitiveadvantageoveritscompetitors.Itis,therefore,withheldfromdisclosuretoprotecttheWestinghousecompetitiveposition.(b)Itisinformationwhichismarketableinmanyways.TheextenttowhichsuchinformationisavailabletocompetitorsdiminishestheWestinghouseabilitytosellproductsandservicesinvolvingtheuseoftheinformation.n27c-RsLAAM794
