District (thelicensee),foroperationoftheRanchoSecoNuclearGenerating Station, located in Sacramento County, California. Notice of consideration of issuance of this amendment was published in the FEDERAL REGISTER on June i

23, 1983, 48 FR 28765; December 21, 1983, 48 FR 56510; and April 23, 1985, 50 l

FR 16012.

The licensee proposed a specification to established operability requirements for the essential heating, ventilation and air conditioning f

(HVAC)systemsfortheNuclearServiceElectricalBuilding.

As set forth in j

t the Commission's related Safety Evaluation, this change was denied because the proposed operability requirements for the essential HVAC systen are less l

stringent than the operability requirements for the system it serves. The

Comission's position is that a system is only operabic if all the auxiliaries necessary for its operation are also operable.

In addition, the Comission denied the licensee's proposed change to Specification 6.9.5, Special Reports, because of possible ambiguities that could be created by an incomplete list of references.

By July 12, 1985, the licensee may file a request for a hearing with respect to the denial described above and any person whose interest may be affe:ted by this denial and who wishes to participate as a party in the i

proceeding must file a written petition for leave to intervene. Requests for I

hearings and petitions for leave to intervene shall be filed in accordance with the Conmission's " Rules of practice for Domestic Licensing proceedings" in 10 CFR Part 2.

A request for a hearing or petition for leave to intervene must be filed with the Secretary of the Conmission, U.S. Nuclear Regulatory Cocmission, Washington. 0.C. 20555, Attention:

Docketing and Service Branch, or may be delivered to the Conmission's public Document Room,1717 H Street, N.W.

Washington 0.C., by the above date. Where petitions are filed the last ten (10) days of the notico period, it is requested that the petitioner promptly so inform the Commission by a toll-free telephone call to Western Union at (800) 325-6000 (in Missouri (800) 342-6700).

The Western Union operator should be given Datagram Identificatinn Number 3737 anl the following message addressed to John Stolz petitioner's name and telephone numbert date petition was mailedt plant name; and publication date and page number of this FEDERAL REGISTER notice.
