Dear Mr. Schneider,

This email is to acknowledge the receipt of Kewaunee Solutions, Inc. submittal (KS-2023-005) docketed on March 29, 2023 (Agencywide Documents Access and Management System [ADAMS] Accession Number ML23093A030), requesting the U.S. Nuclear Regulatory Commission (NRC) to review and approve an exemption from 10 CFR 50.82(a)(8)(i)(A) allowing Kewaunee Solutions (KS) to use funds from the Kewaunee Power Station decommissioning trust fund (Trust) for site restoration activities, consistent with the Post-Shutdown Decommissioning Activities Report and pursuant to 10 CFR 50.12, an exemption from 10 CFR 50.75(h)(1)(iv),

to allow Trust disbursements for site restoration activities to be made without prior notice, similar to withdrawals in accordance with 10 CFR 50.82(a)(8). As part of the acceptance review of your submittal, the NRC will provide a preliminary review, hours, and anticipated completion date based upon our current review schedules. Your request has been assigned Enterprise Project Identifier: L-2023-LLE-0008.

Please reference this number in any future correspondence associated with this request.

The NRC staff will evaluate your submittal and determine if the HDI application contains sufficient information to allow the staff to complete the detailed review. If the application does not contain sufficient information for the staff, then a Request for Supplemental Information (RSI) will be issued, and the staff will provide HDI an opportunity to discuss the RSI and to clarify a final resolution.

In accordance with 10 CFR 2.390 of the NRCs Agency Rules of Practice and Procedure, a copy of this letter will be available electronically for public inspection in the NRC Public Document Room or from the Publicly Available Records component of the NRCs ADAMS.
